Assembly Joint RESOLUTION—Proposing to amend the Constitution of the State of Nevada to allow the legislature to authorize this State to operate a lottery for the support of public education.
1-1 Resolved by the Assembly and Senate of the State of Nevada,
1-2 Jointly, That section 24 of article 4 of the Constitution of the State of
1-3 Nevada be amended to read as follows:
1-4 [Sec:] Sec. 24. 1. Except as otherwise provided in [subsection 2,]
1-5 subsections 2 and 3, no lottery may be authorized by this State, nor may
1-6 lottery tickets be sold.
1-7 [2. The State and the political subdivisions thereof shall not] No
1-8 political subdivision of this State may operate a lottery.
1-9 2. The legislature may authorize persons engaged in charitable
1-10 activities or activities not for profit to operate a lottery in the form of a
1-11 raffle or drawing on their own behalf. All proceeds of the lottery, less
1-12 expenses directly related to the operation of the lottery, must be used only
1-13 to benefit charitable or nonprofit activities in this state. A charitable or
1-14 nonprofit organization shall not employ or otherwise engage any person to
1-15 organize or operate its lottery for compensation. The legislature may
1-16 provide by law for the regulation of such lotteries.
1-17 3. The legislature may authorize a lottery to be operated by this State.
1-18 If the legislature authorizes such a lottery, the legislature shall, by law:
2-1 (a) Provide that tickets for such a lottery may only be sold in an
2-2 establishment that holds a nonrestricted gaming license.
2-3 (b) Provide for the creation of a fund in the state treasury for the
2-4 deposit of all proceeds from the lottery.
2-5 (c) Provide for the disbursement of all money in the fund, less
2-6 expenses directly related to the operation of the lottery, to the school
2-7 districts in this State in a fair and equitable manner.
2-8 (d) Ensure that the money in the fund is used only to supplement and
2-9 not to replace the money that a school district would otherwise receive
2-10 from this State.
2-11 (e) Ensure that a school district which receives money from the fund
2-12 uses the money only to supplement and not to replace the money that the
2-13 school district would otherwise expend for:
2-14 (1) Increases in the salaries and other compensation of licensed
2-15 teachers and other educational personnel employed by the school district;
2-16 (2) Textbooks, library books, and instructional supplies and
2-17 materials;
2-18 (3) Educational technology; and
2-19 (4) Renovation and repair of school buildings and facilities.
