AN ACT relating to gaming; requiring gaming licensees to pay a person who operates a
gaming device to make a wager regardless of the malfunction of the gaming
device unless the person making the wager intentionally caused the malfunction;
and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section
1. Chapter 463 of NRS is hereby
amended by adding thereto a
1-2 new section to read as follows:
1-3 1. Except as otherwise provided in subsection 2, if a gaming device
is
1-4 made available by
a licensee to a person to operate to make a wager and
1-5 following the
wager the gaming device indicates that the person has won
1-6 the wager, the
licensee shall pay the person the full amount the device
1-7 indicates the
person has won, notwithstanding the fact that:
1-8 (a) The gaming device or associated equipment
used in connection
1-9 with the device
malfunctioned; or
1-10 (b) The gaming device displays an externally
visible notice that any
1-11 malfunction of
the device or its associated equipment voids the play.
1-12 2. The
provisions of subsection 1 do not apply if the person making
1-13 the wager or his
agent or accomplice intentionally caused the gaming
1-14 device or its
associated equipment to malfunction.
1-15 Sec. 2. The
amendatory provisions of this act apply to wagers made
1-16 on or after October 1, 2001.
