AN ACT relating to gaming; authorizing certain facilities for senior citizens to conduct bingo games under certain circumstances; prohibiting certain organizations that conduct bingo games from allowing persons less than 21 years of age to participate; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 463 of NRS is hereby amended by adding thereto

1-2  the provisions set forth as sections 2 and 3 of this act.

1-3    Sec. 2.  “Senior citizens’ facility” means:

1-4    1.  A bona fide senior citizens’ center that is not operated for profit

1-5  and provides social or recreational activities for senior citizens; or

1-6    2.  A facility for hospice care, a facility for intermediate care, a

1-7  facility for skilled nursing, a facility for the care of adults during the day

1-8  or a residential facility for groups, as defined and licensed pursuant to

1-9  chapter 449 of NRS, that provides social or recreational activities for the

1-10  residents or patients of the facility.

1-11  Sec. 3.  A senior citizens’ facility may operate a bingo game without

1-12  obtaining a license pursuant to NRS 463.160 if:

1-13  1.  It complies with all the requirements applicable to qualified

1-14  organizations that conduct charitable bingo games pursuant to the

1-15  provisions of NRS 463.4094 to 463.4096, inclusive; and

1-16  2.  No person makes money for operating the game, except as a

1-17  player.

1-18  Sec. 4.  NRS 463.4091 is hereby amended to read as follows:

1-19  463.4091  As used in NRS 463.4091 to 463.40965, inclusive, and

1-20  sections 2 and 3 of this act, unless the context otherwise requires, the

1-21  words and terms defined in NRS 463.40915 to 463.4093, inclusive, and

1-22  section 2 of this act, have the meanings ascribed to them in those sections.


2-1    Sec. 5.  NRS 463.4096 is hereby amended to read as follows:

2-2    463.4096  A qualified organization shall not:

2-3    1.  Compensate any person for the provision of prizes and supplies used

2-4  in the operation of charitable bingo in an amount that exceeds the fair

2-5  market value of the prizes and supplies necessary for the operation of

2-6  charitable bingo.

2-7    2.  Provide:

2-8    (a) Any compensation to a person who is not a regular employee of the

2-9  organization; [and] or

2-10  (b) Any additional compensation to a person who is a regular employee

2-11  of the organization,

2-12  for his services in organizing or operating charitable bingo or assisting in

2-13  the organization or operation of charitable bingo. This subsection does not

2-14  prohibit a qualified organization from compensating a person for the fair

2-15  market value of services that are ancillary to the organization or operation

2-16  of charitable bingo.

2-17  3.  Allow a person less than 21 years of age to participate in a

2-18  charitable bingo game conducted pursuant to NRS 463.4091 to

2-19  463.40965, inclusive, and sections 2 and 3 of this act.

2-20  Sec. 6.  This act becomes effective upon passage and approval.
