AN ACT relating to taxicabs; requiring the taxicab authority to establish a program for
the transportation by taxicab of elderly persons and permanently handicapped
persons in certain counties; and providing other matters properly relating
thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 706
of NRS is hereby amended by adding thereto a
1-2 new section to read as
follows:
1-3 1. The taxicab authority shall adopt regulations
establishing a
1-4 program for the transportation by taxicab of elderly persons and
1-5 permanently handicapped persons.
1-6 2. The program must require the administrator
to:
1-7 (a) Establish and maintain a
telephone number for elderly persons
1-8 and permanently handicapped persons to request transportation by
1-9 taxicab;
1-10 (b) Assign the requests for
transportation by taxicab of elderly persons
1-11 and permanently handicapped persons equitably among the certificate
1-12 holders; and
1-13 (c) Monitor and report to
the taxicab authority on the performance of
1-14 each certificate holder in fulfilling the requests for
transportation by
1-15 taxicab of elderly persons and permanently handicapped persons
1-16 assigned to him by the administrator.
1-17 3. The taxicab authority shall require a
certificate holder to
1-18 participate in the program as a condition of exercising the rights
granted
1-19 by his certificate.
1-20 4. As used in this section:
1-21 (a) “Elderly person” means a
person who is 60 years of age or older.
2-1 (b) “Permanently handicapped
person” means a person who provides
2-2 the administrator with a certificate from a physician licensed in
this state
2-3 that describes the character and extent of the permanent handicap.
2-4 Sec. 2. NRS 706.881 is hereby amended to read as follows:
2-5 706.881 1. The
provisions of NRS 706.8811 to 706.885, inclusive,
2-6 and section 1 of this act apply to any county:
2-7 (a) Whose population is 400,000 or more; or
2-8 (b) For whom regulation by the taxicab authority is not required , if [its]
2-9 the board of county commissioners of the county has enacted an ordinance
2-10 approving the inclusion of
the county within the jurisdiction of the taxicab
2-11 authority.
2-12 2. Upon receipt of a
certified copy of such an ordinance from a county
2-13 for whom regulation by the
taxicab authority is not required, the taxicab
2-14 authority shall exercise its
regulatory authority pursuant to NRS 706.8811
2-15 to 706.885, inclusive,
within that county.
2-16 3. Within any such county,
the provisions of this chapter which confer
2-17 regulatory authority over
taxicab motor carriers upon the transportation
2-18 services authority do not
apply.
2-19 Sec. 3. This act becomes effective on July 1, 2001.
