AN ACT relating to education; providing for the gubernatorial appointment of the superintendent of public instruction; specifying the date for expiration of the term of office of the incumbent superintendent of public instruction; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 385.150 is hereby amended to read as follows:
1-2 385.150 1. The [state board] governor shall appoint the
1-3 superintendent of public instruction for a term of 3 years. The [state board]
1-4 governor may remove the superintendent of public instruction from office
1-5 for inefficiency, neglect of duty, malfeasance in office or for other just
1-6 cause.
1-7 2. A vacancy must be filled by the [state board] governor for the
1-8 remainder of the unexpired term.
1-9 3. The superintendent of public instruction is in the unclassified
1-10 service of the state.
1-11 Sec. 2. NRS 385.170 is hereby amended to read as follows:
1-12 385.170 The superintendent of public instruction shall not pursue any
1-13 other business or occupation or hold any other office of profit without the
1-14 approval of the [state board of education.] governor.
1-15 Sec. 3. 1. The term of office of the superintendent of public
1-16 instruction who is incumbent on December 31, 2001, expires on that date.
1-17 2. Not later than January 1, 2002, the governor shall appoint a person
1-18 to serve as the superintendent of public instruction pursuant to section 1 of
1-19 this act whose term commences on January 1, 2002.
1-20 Sec. 4. This act becomes effective on July 1, 2001.
