AN ACT relating to the control of weeds; providing for the administration of a program to provide grants for the local treatment and control of invasive species of weeds that are not native to Nevada; making appropriations to carry out the program; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1.  1.  The Director shall administer a program to provide

1-2  grants for the local treatment and control of invasive species of weeds that

1-3  are not native to Nevada. In carrying out the program, the Director shall:

1-4    (a) Each fiscal year solicit in every county of this state proposals from

1-5  qualified entities to carry out one or more projects. Each proposal must

1-6  require a qualified entity to provide not less than 25 percent of the cost of a

1-7  project, through the contribution of money received from any source other

1-8  than the state, services in kind, or any combination of such money and

1-9  services.

1-10    (b) Establish priorities for the evaluation of proposals from qualified

1-11  entities and award grants to qualified entities on a competitive basis.

1-12    2.  The recipient of a grant awarded pursuant to subsection 1:

1-13    (a) Shall not use any part of the grant for the payment of any

1-14  administrative fees or expenses.

1-15    (b) Shall submit to the Director, not later than:

1-16      (1) Ninety days after the completion of the project for which the grant

1-17  was received; or


2-1       (2) The last day of the fiscal year for which the grant was
received,

2-2  whichever occurs later, a written report on the project. The report must

2-3  include, without limitation, a statement of the amount of acreage treated for

2-4  the control of each pertinent species of weed and the methods of treatment

2-5  used.

2-6    3.  The Director shall compile the information contained in the reports

2-7  he receives pursuant to subsection 2 and, on or before December 31, 2002,

2-8  submit a summary of the results of the program administered pursuant to

2-9  this section to the Governor and to the Director of the Legislative Counsel

2-10  Bureau for transmittal to the appropriate standing committees of the 72nd

2-11  session of the Nevada Legislature.

2-12    4.  As used in this section:

2-13    (a) “Director” means the Director of the State Department of

2-14  Agriculture.

2-15    (b) “Project” means a local project for the treatment and control of one

2-16  or more invasive species of weeds that are not native to Nevada.

2-17    (c) “Qualified entity” means:

2-18      (1) A county;

2-19      (2) A conservation district created pursuant to chapter 548 of NRS

2-20  before July 1, 2001; or

2-21      (3) A weed control district created pursuant to chapter 555 of NRS

2-22  before July 1, 2001.

2-23    Sec. 2.  1.  There is hereby appropriated from the state general fund

2-24  to the State Department of Agriculture to carry out section 1 of this act:

2-25  For the fiscal year 2001-2002. $250,000

2-26  For the fiscal year 2002-2003. $250,000

2-27    2.  Any remaining balance of the appropriation made by subsection 1

2-28  for:

2-29    (a) The fiscal year 2001-2002 must be transferred and added to the

2-30  money appropriated for the fiscal year 2002-2003.

2-31    (b) The fiscal year 2002-2003, including any money added thereto

2-32  pursuant to paragraph (a), must not be committed for expenditure after

2-33  June 30, 2003, and reverts to the state general fund as soon as all payments

2-34  of money committed have been made.

2-35    Sec. 3.  1.  The Director of the State Department of Agriculture shall

2-36  contract with an independent contractor to serve as a coordinator for the

2-37  program required pursuant to section 1 of this act. The program coordinator

2-38  shall maintain an office in Elko, Nevada, and provide the Director with

2-39  such technical and managerial assistance as the Director requires to carry

2-40  out the program.

2-41    2.  There is hereby appropriated from the state general fund to the State

2-42  Department of Agriculture to carry out subsection 1:

2-43  For the fiscal year 2001-2002. $100,000

2-44  For the fiscal year 2002-2003. $100,000

2-45    3.  Any balance of the sums appropriated by subsection 2 remaining at

2-46  the end of the respective fiscal years must not be committed for

2-47  expenditure after June 30 of the respective fiscal years and reverts to the


3-1  state general fund as soon as all payments of money committed have been

3-2  made.

3-3    Sec. 4.  1.  This act becomes effective on July 1, 2001.

3-4    2.  Section 1 of this act expires by limitation on June 30, 2003.
