AN ACT relating to state employees; providing that classified employees who receive a
salary below a certain amount are entitled to receive pay for time spent on
standby status; requiring certain employees of the department of prisons to
attend muster and entitling such employees to receive pay for attending muster;
and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 284 of NRS is hereby amended by adding thereto a
1-2 new section to read as
follows:
1-3 1. A classified employee:
1-4 (a) Whose position is
classified at grade 42 or lower under the pay
1-5 plan adopted pursuant to NRS 284.175 that is in existence on
January 1,
1-6 2001, or whose position is given an equivalent classification of
grade
1-7 under any pay plan adopted pursuant to NRS 284.175 after January 1,
1-8 2001; and
1-9 (b) Who is required to be on
standby status,
1-10 is entitled to receive compensation at the rate of 10 percent of
his regular
1-11 hourly rate for every hour he is on standby status.
1-12 2. An employee is on standby status when he:
1-13 (a) Remains available during
specified hours for notification to report
1-14 to work;
1-15 (b) Is prepared to work if
the need arises, regardless of whether need
1-16 actually arises;
1-17 (c) Is able to report to
work within a reasonable time;
1-18 (d) Carries a paging device
or provides a telephone number or
1-19 another means acceptable to his supervisor by which he may be
notified;
1-20 and
2-1 (e) Is allowed to use the
time he is waiting for notification to work for
2-2 his personal pursuits.
2-3 3. An employee ceases to be on standby status
when he begins
2-4 performing the duties of his employment after receiving notice to
work
2-5 and remains off standby status while performing such duties.
2-6 Sec. 2. Chapter 209 of NRS is hereby amended by adding thereto a
2-7 new section to read as
follows:
2-8 A correctional officer of
the department, including a correctional
2-9 officer trainee, senior correctional officer, correctional sergeant
and
2-10 correctional lieutenant:
2-11 1. Shall report for muster 30 minutes before the
beginning of his
2-12 shift; and
2-13 2. Is entitled to receive pay for attending
muster at his regular rate of
2-14 pay or if the time spent attending muster is time that would be
considered
2-15 overtime pursuant to NRS 284.180, at the applicable rate for
working
2-16 overtime.
2-17 3. As used in this section, “muster” means the
act of assembling for
2-18 the purpose of taking roll call or receiving information.
2-19 Sec. 3. This act becomes effective on July 1, 2001.
