AN ACT relating to courts; increasing the number of district judges in the second and eighth judicial districts; increasing the number of district judges in the second and eighth judicial districts who must be judges of the family court; making appropriations; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 3.012 is hereby amended to read as follows:

1-2    3.012  For the second judicial district there must be [11] 12 district

1-3  judges, [3] 4 of whom must be judges of the family court.

1-4    Sec. 2.  NRS 3.018 is hereby amended to read as follows:

1-5    3.018  For the eighth judicial district there must be [30] 33 district

1-6  judges, [11] 12 of whom must be judges of the family court.

1-7    Sec. 3.  The additional district judge required for the second judicial

1-8  district pursuant to section 1 of this act and the additional district judges

1-9  required for the eighth judicial district pursuant to section 2 of this act must

1-10  be selected at the general election held on November 5, 2002, and take

1-11  office on January 6, 2003. The terms of these judges expire on January 5,

1-12  2009.

1-13    Sec. 4.  1. There is hereby appropriated from the state general fund

1-14  to the district judges’ salary account the sum of $81,588 for the salary of

1-15  the additional district judge required pursuant to section 1 of this act.


2-1    2.  There is hereby appropriated from the state general fund to the

2-2  district judges’ salary account the sum of $244,764 for the salaries of the

2-3  additional district judges required pursuant to section 2 of this act.

2-4    3.  Any remaining balance of the appropriations made by subsections 1

2-5  and 2 must not be committed for expenditure after June 30, 2003, and

2-6  reverts to the state general fund as soon as all payments of money

2-7  committed have been made.

2-8    Sec. 5.  The provisions of subsection 1 of NRS 354.599 do not apply

2-9  to any additional expenses of a local government that are related to the

2-10  provisions of this act.

2-11    Sec. 6.  1.  This section and sections 3 and 5 of this act become

2-12  effective on October 1, 2001.

2-13    2.  Section 4 of this act becomes effective on January 1, 2003.

2-14    3.  Sections 1 and 2 of this act become effective at 12:01 a.m. on

2-15  January 6, 2003.
