AN ACT relating to fire services; directing the Legislative Commission to conduct an interim study concerning the State Fire Marshal Division of the Department of Motor Vehicles and Public Safety; and providing other matters properly relating thereto.

 

   Whereas, The fire service of the state has, for more than 20 years, been making recommendations regarding the State Fire Marshal Division of the Department of Motor Vehicles and Public Safety; and

   Whereas, The majority of such recommendations made by the fire service of the state have not been addressed; and

   Whereas, Many issues regarding the State Fire Marshal Division of the Department of Motor Vehicles and Public Safety are affecting agencies that provide fire services within this state in a negative manner; and

   Whereas, Many duties and functions assigned by law to the State Fire Marshal Division of the Department of Motor Vehicles and Public Safety are not being performed or are not being performed in their entirety; and

   Whereas, The Governor of this state currently appoints members to both the State Board of Fire Services and the Fire Service Standards and Training Committee; and

   Whereas, The safety and well-being of the residents of and visitors to this state depends upon the agencies that provide fire services within this state; now, therefore

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 


2-1    Section 1. 1.  The Legislative Commission shall appoint a

2-2  subcommittee consisting of legislators to conduct an interim study of the

2-3  State Fire Marshal Division of the Department of Motor Vehicles and

2-4  Public Safety.

2-5    2.  In addition to the subcommittee described in subsection 1, the

2-6  Legislative Commission shall appoint an advisory committee to assist the

2-7  subcommittee. The advisory committee must consist of the members of:

2-8    (a) The State Board of Fire Services; and

2-9    (b) The Fire Service Standards and Training Committee.

2-10    3.  The interim study described in subsection 1 must include, without

2-11  limitation, a comprehensive assessment of:

2-12    (a) The funding, organization, staffing, functions, efficiency and

2-13  accountability of the State Fire Marshal Division of the Department of

2-14  Motor Vehicles and Public Safety;

2-15    (b) The legislative mandates imposed upon the State Fire Marshal

2-16  Division of the Department of Motor Vehicles and Public Safety;

2-17    (c) The levels of service provided by the State Fire Marshal Division of

2-18  the Department of Motor Vehicles and Public Safety and the methods of

2-19  delivering such service; and

2-20    (d) The relationship between the State Fire Marshal Division of the

2-21  Department of Motor Vehicles and Public Safety and other agencies that

2-22  provide fire services within this state.

2-23    4.  The Department of Motor Vehicles and Public Safety shall provide

2-24  administrative and financial support to carry out the interim study.

2-25    Sec. 2. 1.  The Legislative Commission shall submit a report of the

2-26  results of the interim study conducted pursuant to section 1 of this act and

2-27  any recommended legislation to the 72nd session of the Nevada

2-28  Legislature. The report must address each component of the interim study

2-29  described in section 1 of this act.

2-30    2.  Any recommended legislation proposed by the subcommittee

2-31  appointed pursuant to section 1 of this act must be approved by a majority

2-32  of the members of the Senate and a majority of the members of the

2-33  Assembly appointed to the subcommittee.
