AN ACT relating to education; revising the provisions governing the distribution of money from the state to school districts and charter schools; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 387.185 is hereby amended to read as follows:

1-2    387.185  1.  Except as otherwise provided in subsection 2 and NRS

1-3  387.528, all school money due each county school district must be

1-4  paid over by the state treasurer to the county treasurer on August 1,

1-5  November 1, February 1 and May 1 of each year , or as soon thereafter as

1-6  [the county treasurer may apply for it,] practicable based upon the cash

1-7  balances in the state general fund, upon the warrant of the state controller

1-8  drawn in conformity with the apportionment of the superintendent of

1-9  public instruction as provided in NRS 387.124.

1-10    2.  Except as otherwise provided in NRS 387.528, if the board of

1-11  trustees of a school district establishes and administers a separate account

1-12  pursuant to the provisions of NRS 354.603, all school money due that

1-13  school district must be paid over by the state treasurer to the school district

1-14  on August 1, November 1, February 1 and May 1 of each year , or as soon

1-15  thereafter as [the school district may apply for it,] practicable based upon

1-16  the cash balances in the state general fund, upon the warrant of the state

1-17  controller drawn in conformity with the apportionment of the

1-18  superintendent of public instruction as provided in NRS 387.124.


2-1    3.  No county school district may receive any portion of the public

2-2  school money unless that school district has complied with the provisions

2-3  of this Title and regulations adopted pursuant thereto.

2-4    4.  Except as otherwise provided in this subsection, all school money

2-5  due each charter school must be paid over by the state treasurer to the

2-6  governing body of the charter school on August 1, November 1, February 1

2-7  and May 1 of each year , or as soon thereafter as [the governing body may

2-8  apply for it,] practicable based upon the cash balances in the state

2-9  general fund, upon the warrant of the state controller drawn in conformity

2-10  with the apportionment of the superintendent of public instruction as

2-11  provided in NRS 387.124. If the superintendent of public instruction has

2-12  approved, pursuant to subsection 2 of NRS 387.124, a request for payment

2-13  of an apportionment 30 days before the apportionment is otherwise

2-14  required to be made, the money due [to] the charter school must be paid by

2-15  the state treasurer to the governing body of the charter school on July 1,

2-16  October 1, January 1 or April 1, as applicable.

2-17    Sec. 2.  This act becomes effective on July 1, 2001.
