AN ACT relating to health care; requiring the department of human resources to include continuous subcutaneous insulin infusion pumps and podiatric services in the state plan for Medicaid to the extent authorized by federal law; making an appropriation to the department to provide such services; making an appropriation to the University of Nevada School of Medicine for the program administered by the Pediatric Diabetes and Endocrinology Center; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 422 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    To the extent authorized by federal law, the director shall include in

1-4  the state plan for Medicaid as health care services that will be provided

1-5  under the state plan:

1-6    1.  Continuous subcutaneous insulin infusion pumps and medication,

1-7  equipment, supplies, appliances and services related to the use of such

1-8  pumps for each person whose physician has indicated that a pump is

1-9  medically necessary; and

1-10    2.  Podiatric services.

1-11    Sec. 2.  NRS 422.240 is hereby amended to read as follows:

1-12    422.240  1.  Money to carry out the provisions of NRS 422.001 to

1-13  422.410, inclusive, and section 1 of this act, and 422.580, including,


2-1  without limitation, any federal money allotted to the State of Nevada

2-2  pursuant to the program to provide temporary assistance for needy families

2-3  and the program for child care and development, must be provided by

2-4  appropriation by the legislature from the state general fund.

2-5    2.  Disbursements for the purposes of NRS 422.001 to 422.410,

2-6  inclusive, and section 1 of this act, and 422.580 must be made upon claims

2-7  duly filed, audited and allowed in the same manner as other money in the

2-8  state treasury is disbursed.

2-9    Sec. 3.  NRS 232.320 is hereby amended to read as follows:

2-10    232.320  1.  Except as otherwise provided in subsection 2, the

2-11  director:

2-12    (a) Shall appoint, with the consent of the governor, administrators of the

2-13  divisions of the department, who are respectively designated as follows:

2-14      (1) The administrator of the aging services division;

2-15      (2) The administrator of the health division;

2-16      (3) The state welfare administrator;

2-17      (4) The administrator of the division of child and family services; and

2-18      (5) The administrator of the division of health care financing and

2-19  policy.

2-20    (b) Shall administer, through the divisions of the department, the

2-21  provisions of chapters 210, 423, 424, 425, 427A, 432A to 442, inclusive,

2-22  446 to 450, inclusive, of NRS, NRS 127.220 to 127.310, inclusive, 422.001

2-23  to 422.410, inclusive, and section 1 of this act, 422.580, 432.010 to

2-24  432.139, inclusive, 444.003 to 444.430, inclusive, and 445A.010 to

2-25  445A.055, inclusive, and all other provisions of law relating to the

2-26  functions of the divisions of the department, but is not responsible for the

2-27  clinical activities of the health division or the professional line activities of

2-28  the other divisions.

2-29    (c) Shall, after considering advice from agencies of local governments

2-30  and nonprofit organizations which provide social services, adopt a master

2-31  plan for the provision of human services in this state. The director shall

2-32  revise the plan biennially and deliver a copy of the plan to the governor and

2-33  the legislature at the beginning of each regular session. The plan must:

2-34      (1) Identify and assess the plans and programs of the department for

2-35  the provision of human services, and any duplication of those services by

2-36  federal, state and local agencies;

2-37      (2) Set forth priorities for the provision of those services;

2-38      (3) Provide for communication and the coordination of those services

2-39  among nonprofit organizations, agencies of local government, the state and

2-40  the Federal Government;

2-41      (4) Identify the sources of funding for services provided by the

2-42  department and the allocation of that funding;

2-43      (5) Set forth sufficient information to assist the department in

2-44  providing those services and in the planning and budgeting for the future

2-45  provision of those services; and

2-46      (6) Contain any other information necessary for the department to

2-47  communicate effectively with the Federal Government concerning

2-48  demographic trends, formulas for the distribution of federal money and any

2-49  need for the modification of programs administered by the department.


3-1    (d) May, by regulation, require nonprofit organizations and state and

3-2  local governmental agencies to provide information to him regarding the

3-3  programs of those organizations and agencies, excluding detailed

3-4  information relating to their budgets and payrolls, which he deems

3-5  necessary for his performance of the duties imposed upon him pursuant to

3-6  this section.

3-7    (e) Has such other powers and duties as are provided by law.

3-8    2.  The governor shall appoint the administrator of the division of

3-9  mental health and developmental services.

3-10    Sec. 4.  1.  There is hereby appropriated from the state general fund

3-11  to the department of human resources for including continuous

3-12  subcutaneous insulin infusion pumps and medication, equipment, supplies,

3-13  appliances and services related to the use of such pumps, and podiatric

3-14  services in the state plan for Medicaid:

3-15    For the fiscal year 2001-2002................. $317,088

3-16    For the fiscal year 2002-2003................. $317,088

3-17    2.  Any balance of the sums appropriated by subsection 1 remaining at

3-18  the end of the respective fiscal years must not be committed for

3-19  expenditure after June 30 of the respective fiscal years and reverts to the

3-20  state general fund as soon as all payments of money committed have been

3-21  made.

3-22    Sec. 5.  1.  There is hereby appropriated from the state general fund

3-23  to the University of Nevada School of Medicine for the operation of the

3-24  program administered by the Pediatric Diabetes and Endocrinology Center:

3-25    For the fiscal year 2001-2002................. $284,625

3-26    For the fiscal year 2002-2003................. $284,625

3-27    2.  The sums appropriated by subsection 1 are available for either fiscal

3-28  year. Any balance of those sums must not be committed for expenditure

3-29  after June 30, 2003, and reverts to the state general fund as soon as all

3-30  payments of money committed have been made.

3-31    3.  The money appropriated by subsection 1 must be used to:

3-32    (a) Pay for the general operational costs of the Pediatric Diabetes and

3-33  Endocrinology Center, including, without limitation, expenses related to

3-34  travel;

3-35    (b) Purchase equipment for the Pediatric Diabetes and Endocrinology

3-36  Center; and

3-37    (c) Pay the salaries of professional and support personnel on the multi-

3-38  disciplinary team of the Pediatric Diabetes and Endocrinology Center,

3-39  including, without limitation, pediatric endocrinologists, licensed clinical

3-40  social workers, exercise physiologists, psychologists, health analysts,

3-41  biostatisticians, nurse practitioners, registered nurses and registered

3-42  dietitians.

3-43    4.  The Pediatric Diabetes and Endocrinology Center shall create an

3-44  advisory board consisting of the eight members of the executive committee

3-45  of the Nevada Diabetes Council and three additional members who are

3-46  medical and allied health professionals in the field of diabetes to provide

3-47  advice to the Pediatric Diabetes and Endocrinology Center regarding the

3-48  collaboration between the various state agencies, focusing primarily on the

3-49  care and treatment of children with diabetes.


4-1    5.  The Pediatric Diabetes and Endocrinology Center shall ensure that a

4-2  data analysis is conducted to evaluate the financial situation of the program

4-3  administered by the center and the medical results of patients who receive

4-4  care under the program. The advisory board shall monitor and review the

4-5  data analysis and provide advice based on the results of the analysis.

4-6    Sec. 6.  This act becomes effective on July 1, 2001.
