AN ACT relating to legislative measures; requiring the preparation of a report on the effect of legislation that requires a policy of health insurance to provide coverage for any treatment or service; providing for the distribution of the report to the members of the legislature and to the governor; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 218 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  The fiscal analysis division of the legislative counsel bureau shall

1-4  prepare a written report on the effect of any bill that requires a policy of

1-5  health insurance delivered or issued for delivery in this state to provide

1-6  coverage for any treatment or service. The report must contain:

1-7    (a) An analysis of the level of public demand for the treatment or

1-8  service for which coverage is required and the extent to which such

1-9  coverage is needed in this state;

1-10    (b) A description of the extent to which coverage for the treatment or

1-11  service is currently available;

1-12    (c) An analysis of the extent to which the required coverage may

1-13  increase or decrease the cost of the treatment or service;

1-14    (d) The effect the required coverage will have on the cost of obtaining

1-15  policies of health insurance in this state;

1-16    (e) The effect the required coverage will have on the cost of health

1-17  care provided in this state, as determined by an independent actuary;

1-18    (f) If the provision is applicable to coverage provided by the state to its

1-19  employees, the effect the required coverage will have on the cost of


2-1  health insurance provided by the state to its employees, as determined by

2-2  the board of the public employees’ benefits program; and

2-3    (g) Such other considerations as are necessary to determine the fiscal

2-4  and social impact of requiring coverage for the treatment or service.

2-5    2.  The fiscal analysis division shall prepare such a report for the

2-6  original bill and for each amended version of the bill.

2-7    3.  The original copy of a report prepared for a bill pursuant to this

2-8  section must be retained by the fiscal analysis division to be used as

2-9  printer’s copy. The fiscal analysis division shall forward the original

2-10  copy to the superintendent of the state printing division of the department

2-11  of administration for the purposes of printing. Each report must be

2-12  printed separate from the bill.

2-13    4.  The fiscal analysis division shall deliver copies of the most recent

2-14  report prepared for a bill pursuant to this section to:

2-15    (a) The requester of the bill;

2-16    (b) The chairman of each committee of the assembly and the senate to

2-17  which such a bill is referred, for distribution to the members of that

2-18  committee at least 3 days before the bill is considered by the committee;

2-19  and

2-20    (c) The chief clerk of the assembly and the secretary of the senate, for

2-21  distribution to the members of their respective houses at least 1 day

2-22  before the bill is considered by that house.

2-23    Sec. 2.  NRS 218.380 is hereby amended to read as follows:

2-24    218.380  1.  An enrolled bill must be delivered by the legislative

2-25  counsel, or such person as he designates in writing, to the governor for his

2-26  action, who may authorize a member of his staff to receive and receipt for

2-27  the [same] bill in his name.

2-28    2.  An enrolled bill that is delivered to the governor and requires a

2-29  policy of health insurance delivered or issued for delivery in this state to

2-30  provide coverage for any treatment or service must be accompanied by

2-31  the written report prepared by the fiscal analysis division for the final

2-32  version of the bill pursuant to section 1 of this act.
