AN ACT relating to crimes; prohibiting bestiality; providing a penalty; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 201 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  A person who, with the intent of arousing or gratifying his sexual

1-4  desire, subjects a beast to sexual penetration or submits to sexual

1-5  penetration by a beast commits bestiality.

1-6    2.  A person who commits bestiality is guilty of a category C felony

1-7  and shall be punished by imprisonment in the state prison for a

1-8  minimum term of not less than 1 year and a maximum term of not more

1-9  than 5 years, or by a fine of not more than $5,000, or by both fine and

1-10  imprisonment.

1-11    3.  As used in this section, “sexual penetration” means cunnilingus,

1-12  fellatio or any intrusion, however slight, of any part of the body of the

1-13  person or the beast into the genital or anal openings of the person or the

1-14  beast.

1-15    Sec. 2.  The amendatory provisions of this act do not apply to an

1-16  offense committed before October 1, 2001.
