AN ACT relating to substances; revising the definition of the “manufacture” of a substance; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 453.091 is hereby amended to read as follows:

1-2    453.091  1.  “Manufacture” means the production, preparation,

1-3  propagation, compounding, conversion or processing of a substance, either

1-4  directly or indirectly by extraction from substances of natural origin, or

1-5  independently by means of chemical synthesis, or by a combination of

1-6  extraction and chemical synthesis, and includes any packaging or

1-7  repackaging of the substance or labeling or relabeling of its container.

1-8    2.  “Manufacture” does not include [the preparation or compounding of

1-9  a substance by a person for his own use or] the preparation, compounding,

1-10  packaging or labeling of a substance by a pharmacist, physician,

1-11  physician’s assistant, dentist, podiatric physician or veterinarian:

1-12    (a) As an incident to his administering or dispensing of a substance in

1-13  the course of his professional practice; or

1-14    (b) By his authorized agent under his supervision, for the purpose of, or

1-15  as an incident to, research, teaching or chemical analysis and not for sale.

1-16    Sec. 2.  The amendatory provisions of this act do not apply to offenses

1-17  committed before October 1, 2001.
