AN ACT relating to public welfare; requiring the department of human resources to establish, upon approval of the interim finance committee, a program for the provision of medical assistance to certain working persons with disabilities; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 422 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  Upon approval of the interim finance committee, the director,

1-4  through the division of health care financing and policy, shall establish a

1-5  program for the provision of medical assistance to certain persons who

1-6  are employed and have disabilities. The director shall establish the

1-7  program by:

1-8    (a) Amending the state plan for Medicaid in the manner set forth in

1-9  42 U.S.C. § 1396a(a)(10)(A)(ii)(XIII);

1-10  (b) Amending the state plan for Medicaid in the manner set forth in

1-11  42 U.S.C. § 1396a(a)(10)(A)(ii)(XV); or

1-12  (c) Obtaining a Medicaid waiver from the federal government to carry

1-13  out the program.

1-14  2.  The director may require a person participating in a program

1-15  established pursuant to subsection 1 to pay a premium or other cost-

1-16  sharing charges in a manner that is consistent with federal law.

 


2-1    Sec. 2.  NRS 232.320 is hereby amended to read as follows:

2-2    232.320  1.  Except as otherwise provided in subsection 2, the

2-3  director:

2-4    (a) Shall appoint, with the consent of the governor, administrators of the

2-5  divisions of the department, who are respectively designated as follows:

2-6       (1) The administrator of the aging services division;

2-7       (2) The administrator of the health division;

2-8       (3) The state welfare administrator;

2-9       (4) The administrator of the division of child and family services; and

2-10      (5) The administrator of the division of health care financing and

2-11  policy.

2-12    (b) Shall administer, through the divisions of the department, the

2-13  provisions of chapters 210, 423, 424, 425, 427A, 432A to 442, inclusive,

2-14  446 to 450, inclusive, of NRS, NRS 127.220 to 127.310, inclusive, 422.001

2-15  to 422.410, inclusive, and section 1 of this act, 422.580, 432.010 to

2-16  432.139, inclusive, 444.003 to 444.430, inclusive, and 445A.010 to

2-17  445A.055, inclusive, and all other provisions of law relating to the

2-18  functions of the divisions of the department, but is not responsible for the

2-19  clinical activities of the health division or the professional line activities of

2-20  the other divisions.

2-21    (c) Shall, after considering advice from agencies of local governments

2-22  and nonprofit organizations which provide social services, adopt a master

2-23  plan for the provision of human services in this state. The director shall

2-24  revise the plan biennially and deliver a copy of the plan to the governor and

2-25  the legislature at the beginning of each regular session. The plan must:

2-26      (1) Identify and assess the plans and programs of the department for

2-27  the provision of human services, and any duplication of those services by

2-28  federal, state and local agencies;

2-29      (2) Set forth priorities for the provision of those services;

2-30      (3) Provide for communication and the coordination of those services

2-31  among nonprofit organizations, agencies of local government, the state and

2-32  the Federal Government;

2-33      (4) Identify the sources of funding for services provided by the

2-34  department and the allocation of that funding;

2-35      (5) Set forth sufficient information to assist the department in

2-36  providing those services and in the planning and budgeting for the future

2-37  provision of those services; and

2-38      (6) Contain any other information necessary for the department to

2-39  communicate effectively with the Federal Government concerning

2-40  demographic trends, formulas for the distribution of federal money and any

2-41  need for the modification of programs administered by the department.

2-42    (d) May, by regulation, require nonprofit organizations and state and

2-43  local governmental agencies to provide information to him regarding the

2-44  programs of those organizations and agencies, excluding detailed

2-45  information relating to their budgets and payrolls, which he deems

2-46  necessary for his performance of the duties imposed upon him pursuant to

2-47  this section.

2-48    (e) Has such other powers and duties as are provided by law.


3-1    2.  The governor shall appoint the administrator of the division of

3-2  mental health and developmental services.

3-3    Sec. 3.  The director of the department of human resources shall

3-4  submit a proposal for a program to be established pursuant to section 1 of

3-5  this act to the interim finance committee for its approval at its first meeting

3-6  after March 1, 2002. The proposal must be designed, to the extent

3-7  practicable, to:

3-8    1.  Require no funding from the state general fund; and

3-9    2.  If approved by the interim finance committee, begin operating based

3-10  on a schedule to develop and carry out the program that is agreed upon by

3-11  the department of human resources, the interim finance committee and the

3-12  Federal Government.

3-13    Sec. 4.  This act becomes effective on July 1, 2001.
