AN ACT relating to the Colorado River commission; expanding the authority of the Colorado River commission to provide electric services to political subdivisions; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 704.987 is hereby amended to read as follows:

1-2    704.987  1.  Except as otherwise provided in this section, the

1-3  Colorado River commission may sell electricity and provide transmission

1-4  service or distribution service, or both, to meet the existing and future

1-5  requirements of:

1-6    (a) Any customer that the Colorado River commission on July 16, 1997,

1-7  was serving or had a contract to serve; [and]

1-8    (b) The Southern Nevada Water Authority[,] ; and

1-9    (c) Any other political subdivision in this state,

1-10  without being subject to the provisions of NRS 704.965 to 704.990,

1-11  inclusive, or to the jurisdiction of the public utilities commission[.] of

1-12  Nevada.

1-13    2.  The Colorado River commission may sell electricity [or] and

1-14  provide transmission service or distribution service, or both, to [customers

1-15  whom the Colorado River commission was not serving, or with whom it

1-16  did not have a contract, on July 16, 1997,] any other customer if the

1-17  Colorado River commission:

1-18    (a) Obtains a license to act as an alternative seller; and


2-1    (b) Allows its system for transmission and distribution to be utilized by

2-2  other alternative sellers pursuant to such terms and conditions as may be

2-3  established by the public utilities commission[.] of Nevada.

2-4    3.  As used in this section, “Southern Nevada Water Authority” has the

2-5  meaning ascribed to it in NRS 538.041.

2-6    Sec. 2.  This act becomes effective upon passage and approval.
