AN ACT relating to drivers’ licenses; requiring the photograph and any information included on the face of a driver’s license or identification card to be placed in a certain manner on the license or card; revising the provisions governing the use of colors on a driver’s license issued to an insulin dependent diabetic or an epileptic; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 483.347 is hereby amended to read as follows:

1-2    483.347  1.  Except as otherwise provided in subsection 2, the

1-3  department shall issue a rectangular-shaped driver’s license which bears a

1-4  front view colored photograph of the licensee . [if he] The photograph and

1-5  any information included on the license must be placed in a manner

1-6  which ensures that:

1-7    (a) If the licensee is 21 years of age or older[, or a profile view colored

1-8  photograph if he] , the longer edges of the rectangle serve as the top and

1-9  bottom of the license; or

1-10    (b) If the licensee is under 21 years of age[.] , the shorter edges of the

1-11  rectangle serve as the top and bottom of the license.

1-12    2.  The department may issue a temporary driver’s license without a

1-13  photograph of the licensee if the licensee is temporarily absent from this

1-14  state and requests the renewal of, the issuance of a duplicate of, or a change

1-15  in the information on, his driver’s license. If the licensee returns to this

1-16  state for 14 continuous days or more, the licensee shall, within 24 days

1-17  after the date of his return, surrender the temporary license and obtain a

1-18  license which bears his photograph in accordance with subsection 1. A

1-19  licensee charged with violating the provisions of this subsection may not

1-20  be convicted if he surrenders the temporary license, obtains a license which


2-1  bears his photograph in accordance with subsection 1 and produces that

2-2  license in court or in the office of the arresting officer.

2-3    3.  The department shall:

2-4    (a) Establish a uniform procedure for the production of drivers’

2-5  licenses, applicable to renewal as well as to original licenses.

2-6    (b) Increase the fees provided in NRS 483.410, 483.820 and 483.910 by

2-7  an amount up to $1. The increase must be deposited in the state treasury for

2-8  credit to the motor vehicle fund and must be allocated to the department to

2-9  defray the increased costs of producing the drivers’ licenses required by

2-10  this section.

2-11    Sec. 2.  NRS 483.348 is hereby amended to read as follows:

2-12    483.348  1.  [The] Except as otherwise provided in subsection 2, the

2-13  department shall issue a driver’s license with a specially colored

2-14  background [in the photograph portion] to any person who qualifies for a

2-15  driver’s license pursuant to the provisions of this chapter and delivers to

2-16  the department a signed statement from a physician that the person is an

2-17  insulin dependent diabetic or an epileptic. The department shall designate

2-18  one color to be used only for a driver’s [licenses] license held by

2-19  [diabetics] a diabetic and another color to be used only for a driver’s

2-20  [licenses] license held by [epileptics.] an epileptic.

2-21    2.  In lieu of issuing a driver’s license pursuant to subsection 1, the

2-22  department may issue to a person specified in that subsection a driver’s

2-23  license with a specially colored border around the photograph on the

2-24  license.

2-25    3.  The department shall provide for the education of peace officers on

2-26  the:

2-27    (a) Effects and treatment of a person suffering from insulin shock or an

2-28  epileptic seizure and the similarity in appearance of a person suffering

2-29  from insulin shock or an epileptic seizure to a person under the influence of

2-30  alcohol or a controlled substance; and

2-31    (b) Procedures for identifying and handling situations involving a

2-32  person suffering from insulin shock or an epileptic seizure.

2-33    Sec. 3.  NRS 483.840 is hereby amended to read as follows:

2-34    483.840  1.  The form of the identification cards must be similar to

2-35  that of drivers’ licenses but distinguishable in color or otherwise.

2-36    2.  Identification cards do not authorize the operation of any motor

2-37  vehicles.

2-38    3.  Identification cards must include the following information

2-39  concerning the holder:

2-40    (a) The name and sample signature of the holder.

2-41    (b) A unique identification number assigned to the holder that is not

2-42  based on the holder’s social security number.

2-43    (c) A personal description of the holder.

2-44    (d) The date of birth of the holder.

2-45    (e) The current address of the holder in this state.

2-46    (f) A colored photograph of the holder . [in full face if he is 21 years of

2-47  age or older, or a colored photograph in profile if he is under 21 years of

2-48  age.]


3-1    4.  The information required to be included on the identification card

3-2  pursuant to subsection 3 must be placed on the card in the manner

3-3  specified in subsection 1 of NRS 483.347.

3-4    5.  At the time of the issuance of the identification card, the department

3-5  shall give the holder the opportunity to indicate on his identification card

3-6  that he wishes to be a donor of all or part of his body pursuant to NRS

3-7  451.500 to 451.590, inclusive, or that he refuses to make an anatomical gift

3-8  of his body or part of his body.

3-9    [5.] 6.  As used in this section, “photograph” has the meaning ascribed

3-10  to it in NRS 483.125.

3-11    Sec. 4.  Notwithstanding the amendatory provisions of this act:

3-12    1.  A driver’s license that is issued or renewed before July 1, 2001, is

3-13  valid, unless suspended or revoked, for the period for which it is issued or

3-14  renewed.

3-15    2.  A driver’s license that is renewed by mail in accordance with NRS

3-16  483.383 on or after July 1, 2001, but before July 1, 2005, is valid, unless

3-17  suspended or revoked, for the period for which it is renewed.

3-18    3.  An identification card that is issued before July 1, 2001, is valid

3-19  until July 1, 2009, unless the director of the department of motor vehicles

3-20  and public safety recalls and cancels the card pursuant to NRS 483.830 or

3-21  the card is required to be surrendered to the department pursuant to NRS

3-22  483.870.

3-23    Sec. 5.  This act becomes effective on July 1, 2001.
