AN ACT relating to drivers’ licenses; requiring the photograph and any information included on the face of a driver’s license or identification card to be placed in a certain manner on the license or card; revising the provisions governing the use of colors on a driver’s license issued to an insulin dependent diabetic or an epileptic; providing that courses in automobile driver education in public schools must be limited to pupils who have attained a certain age; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 483.250 is hereby amended to read as follows:

1-2    483.250  The department shall not issue any license under the

1-3  provisions of NRS 483.010 to 483.630, inclusive:

1-4    1.  To any person who is under the age of 18 years, except that the

1-5  department may issue:

1-6    (a) A restricted license to a person between the ages of 14 and 18 years

1-7  pursuant to the provisions of NRS 483.267 and 483.270.

1-8    (b) An instruction permit to a person who is at least 15 1/2 years of age

1-9  pursuant to the provisions of subsection 1 of NRS 483.280.

1-10    (c) A restricted instruction permit to a person under the age of 18 years

1-11  pursuant to the provisions of subsection 3 of NRS 483.280.

1-12    (d) Except as otherwise provided in paragraph (e), a license to a person

1-13  between the ages of 16 and 18 years [who] if:

1-14      (1) He has completed a course [:

1-15      (1) In] in automobile driver education pursuant to NRS 389.090 [; or

1-16      (2) Provided] or a course provided by a school for training drivers

1-17  licensed pursuant to NRS 483.700 to 483.780, inclusive, if the course

1-18  complies with the applicable regulations governing the establishment,


2-1  conduct and scope of automobile driver education adopted by the state

2-2  board of education pursuant to NRS 389.090 [,

2-3  and who has] ;

2-4       (2) He has at least 50 hours of experience in driving a motor vehicle

2-5  with a restricted license, instruction permit or restricted instruction permit

2-6  issued pursuant to NRS 483.267, 483.270 or 483.280 [. The] ; and

2-7       (3) His parent or legal guardian [of a person who desires to obtain a

2-8  license pursuant to this paragraph must sign and submit] has signed and

2-9  submitted to the department a form provided by the department which

2-10  attests that the person who [desires a] wishes to obtain the license has

2-11  completed the training and experience required by this paragraph.

2-12    (e) A license to a person who is between the ages of 16 and 18 years if:

2-13      (1) The public school in which he is enrolled is located in a county

2-14  whose population is less than 35,000 or in a city or town whose population

2-15  is less than 25,000;

2-16      (2) The public school does not offer automobile driver education;

2-17      (3) He has at least 50 hours of experience in driving a motor vehicle

2-18  with a restricted license, instruction permit or restricted instruction permit

2-19  issued pursuant to NRS 483.267, 483.270 or 483.280; and

2-20      (4) His parent or legal guardian signs and submits to the department a

2-21  form provided by the department which attests that the person who [desires

2-22  a] wishes to obtain the license has completed the experience required by

2-23  subparagraph (3).

2-24    2.  To any person whose license has been revoked until the expiration

2-25  of the period during which he is not eligible for a license.

2-26    3.  To any person whose license has been suspended, but, upon good

2-27  cause shown to the administrator, the department may issue a restricted

2-28  license to him or shorten any period of suspension.

2-29    4.  To any person who has previously been adjudged to be afflicted

2-30  with or suffering from any mental disability or disease and who has not at

2-31  the time of application been restored to legal capacity.

2-32    5.  To any person who is required by NRS 483.010 to 483.630,

2-33  inclusive, to take an examination, unless he has successfully passed the

2-34  examination.

2-35    6.  To any person when the administrator has good cause to believe that

2-36  by reason of physical or mental disability that person would not be able to

2-37  operate a motor vehicle safely.

2-38    7.  To any person who is not a resident of this state.

2-39    8.  To any child who is the subject of a court order issued pursuant to

2-40  paragraph (h) of subsection 1 of NRS 62.211, NRS 62.2255, 62.226 or

2-41  62.228 which delays his privilege to drive.

2-42    9.  To any person who is the subject of a court order issued pursuant to

2-43  NRS 206.330 which suspends or delays his privilege to drive until the

2-44  expiration of the period of suspension or delay.

2-45    Sec. 2.  NRS 483.347 is hereby amended to read as follows:

2-46    483.347  1.  Except as otherwise provided in subsection 2, the

2-47  department shall issue a rectangular-shaped driver’s license which bears a

2-48  front view colored photograph of the licensee . [if he] The photograph and


3-1  any information included on the license must be placed in a manner

3-2  which ensures that:

3-3    (a) If the licensee is 21 years of age or older[, or a profile view colored

3-4  photograph if he] , the longer edges of the rectangle serve as the top and

3-5  bottom of the license; or

3-6    (b) If the licensee is under 21 years of age[.] , the shorter edges of the

3-7  rectangle serve as the top and bottom of the license.

3-8    2.  The department may issue a temporary driver’s license without a

3-9  photograph of the licensee if the licensee is temporarily absent from this

3-10  state and requests the renewal of, the issuance of a duplicate of, or a change

3-11  in the information on, his driver’s license. If the licensee returns to this

3-12  state for 14 continuous days or more, the licensee shall, within 24 days

3-13  after the date of his return, surrender the temporary license and obtain a

3-14  license which bears his photograph in accordance with subsection 1. A

3-15  licensee charged with violating the provisions of this subsection may not

3-16  be convicted if he surrenders the temporary license, obtains a license which

3-17  bears his photograph in accordance with subsection 1 and produces that

3-18  license in court or in the office of the arresting officer.

3-19    3.  The department shall:

3-20    (a) Establish a uniform procedure for the production of drivers’

3-21  licenses, applicable to renewal as well as to original licenses.

3-22    (b) Increase the fees provided in NRS 483.410, 483.820 and 483.910 by

3-23  an amount up to $1. The increase must be deposited in the state treasury for

3-24  credit to the motor vehicle fund and must be allocated to the department to

3-25  defray the increased costs of producing the drivers’ licenses required by

3-26  this section.

3-27    Sec. 3.  NRS 483.348 is hereby amended to read as follows:

3-28    483.348  1.  [The] Except as otherwise provided in subsection 2, the

3-29  department shall issue a driver’s license with a specially colored

3-30  background [in the photograph portion] to any person who qualifies for a

3-31  driver’s license pursuant to the provisions of this chapter and delivers to

3-32  the department a signed statement from a physician that the person is an

3-33  insulin dependent diabetic or an epileptic. The department shall designate

3-34  one color to be used only for a driver’s [licenses] license held by

3-35  [diabetics] a diabetic and another color to be used only for a driver’s

3-36  [licenses] license held by [epileptics.] an epileptic.

3-37    2.  In lieu of issuing a driver’s license pursuant to subsection 1, the

3-38  department may issue to a person specified in that subsection a driver’s

3-39  license with a specially colored border around the photograph on the

3-40  license.

3-41    3.  The department shall provide for the education of peace officers on

3-42  the:

3-43    (a) Effects and treatment of a person suffering from insulin shock or an

3-44  epileptic seizure and the similarity in appearance of a person suffering

3-45  from insulin shock or an epileptic seizure to a person under the influence of

3-46  alcohol or a controlled substance; and

3-47    (b) Procedures for identifying and handling situations involving a

3-48  person suffering from insulin shock or an epileptic seizure.

 


4-1    Sec. 4.  NRS 483.840 is hereby amended to read as follows:

4-2    483.840  1.  The form of the identification cards must be similar to

4-3  that of drivers’ licenses but distinguishable in color or otherwise.

4-4    2.  Identification cards do not authorize the operation of any motor

4-5  vehicles.

4-6    3.  Identification cards must include the following information

4-7  concerning the holder:

4-8    (a) The name and sample signature of the holder.

4-9    (b) A unique identification number assigned to the holder that is not

4-10  based on the holder’s social security number.

4-11    (c) A personal description of the holder.

4-12    (d) The date of birth of the holder.

4-13    (e) The current address of the holder in this state.

4-14    (f) A colored photograph of the holder . [in full face if he is 21 years of

4-15  age or older, or a colored photograph in profile if he is under 21 years of

4-16  age.]

4-17    4.  The information required to be included on the identification card

4-18  pursuant to subsection 3 must be placed on the card in the manner

4-19  specified in subsection 1 of NRS 483.347.

4-20    5.  At the time of the issuance of the identification card, the department

4-21  shall:

4-22    (a) Give the holder the opportunity to indicate on his identification card

4-23  that he wishes to be a donor of all or part of his body pursuant to NRS

4-24  451.500 to 451.590, inclusive, or that he refuses to make an anatomical gift

4-25  of his body or part of his body;

4-26    (b) Give the holder the opportunity to indicate whether he wishes to

4-27  donate $1 or more to the anatomical gift account created by section 7 of

4-28  Assembly Bill No. 497 of this[act;]session; and

4-29    (c) Provide to each holder who is interested in becoming a donor

4-30  information relating to anatomical gifts, including the procedure for

4-31  registration as a donor with The Living Bank International or its successor

4-32  organization.

4-33    [5.] 6.  If the holder wishes to make a donation to the anatomical gift

4-34  account, the department shall collect the donation and deposit the money

4-35  collected in the state treasury for credit to the anatomical gift account.

4-36    [6.] 7.  The department shall submit to The Living Bank International,

4-37  or its successor organization, information from the records of the

4-38  department relating to persons who have identification cards issued by the

4-39  department that indicate the intention of those persons to make an

4-40  anatomical gift. The department shall adopt regulations to carry out the

4-41  provisions of this subsection.

4-42    [7.] 8.  As used in this section, “photograph” has the meaning ascribed

4-43  to it in NRS 483.125.

4-44    Sec. 5.  NRS 389.090 is hereby amended to read as follows:

4-45    389.090  1.  The state board shall adopt regulations governing the

4-46  establishment, conduct and scope of automobile driver education in the

4-47  public schools of this state.


5-1    2.  The aims and purposes of automobile driver education are to

5-2  develop the knowledge, attitudes, habits and skills necessary for the safe

5-3  operation of motor vehicles.

5-4    3.  The board of trustees of a school district may establish and maintain

5-5  automobile driver education classes during regular semesters and summer

5-6  sessions and during the regular school day and at times other than during

5-7  the regular school day for:

5-8    (a) Pupils enrolled in the regular full-time day high schools in the

5-9  school district.

5-10    (b) Pupils enrolled in summer classes conducted in high schools in the

5-11  school district.

5-12  A board of trustees maintaining courses in automobile driver education

5-13  shall insure against any liability arising out of the use of motor vehicles in

5-14  connection with those courses. The cost of the insurance must be paid from

5-15  available school district funds.

5-16    4.  A governing body of a charter school may establish and maintain

5-17  automobile driver education classes if the governing body insures against

5-18  any liability arising out of the use of motor vehicles in connection with

5-19  those courses.

5-20    5.  Automobile driver education must be provided by boards of trustees

5-21  of school districts and governing bodies of charter schools in accordance

5-22  with the regulations of the state board and may not be duplicated by any

5-23  other agency, department, commission or officer of the State of Nevada.

5-24    6.  Each course in automobile driver education provided by a board of

5-25  trustees of a school district or a governing body of a charter school must

5-26  include, without limitation, instruction in:

5-27    (a) Motor vehicle insurance.

5-28    (b) The effect of drugs and alcohol on an operator of a motor vehicle.

5-29    7.  Each course in automobile driver education provided by a board of

5-30  trustees of a school district or a governing body of a charter school must be

5-31  restricted to pupils who are [sophomores, juniors or seniors in high school.]

5-32  at least 15 years of age.

5-33    Sec. 6.  Notwithstanding the amendatory provisions of this act:

5-34    1.  A driver’s license that is issued or renewed before July 1, 2001, is

5-35  valid, unless suspended or revoked, for the period for which it is issued or

5-36  renewed.

5-37    2.  A driver’s license that is renewed by mail in accordance with NRS

5-38  483.383 on or after July 1, 2001, but before July 1, 2005, is valid, unless

5-39  suspended or revoked, for the period for which it is renewed.

5-40    3.  An identification card that is issued before July 1, 2001, is valid

5-41  until July 1, 2009, unless the director of the department of motor vehicles

5-42  and public safety recalls and cancels the card pursuant to NRS 483.830 or

5-43  the card is required to be surrendered to the department pursuant to NRS

5-44  483.870.

5-45    Sec. 7.  (Deleted by amendment.)

5-46    Sec. 8.  1.  This section and sections 1, 2, 3, 5, 6 and 7 of this act

5-47  become effective on July 1, 2001.

 


6-1    2.  Section 4 of this act becomes effective at 12:01 a.m. on July 1,

6-2  2001.
