AN ACT relating to elections; requiring a person who holds an elected state or local office to resign that office before he becomes a candidate for a different elected state or local office or an elected federal office under certain circumstances; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 293 of NRS is hereby amended by adding thereto a
1-2 new section to read as follows:
1-3 1. Except as otherwise provided in subsection 2:
1-4 (a) An elected state or local public officer; or
1-5 (b) A person appointed to serve as a state or local public officer
1-6 during a term to which another person was elected,
1-7 may not become a candidate for a different elected state or local office or
1-8 an elected federal office, unless he first resigns his current state or local
1-9 office.
1-10 2. The provisions of subsection 1 do not apply to a public officer
1-11 whose current term of state or local office will end within 3 months after
1-12 the general election for a different public office for which he becomes a
1-13 candidate.
1-14 Sec. 2. Chapter 293C of NRS is hereby amended by adding thereto a
1-15 new section to read as follows:
1-16 1. Except as otherwise provided in subsection 2:
1-17 (a) An elected state or local public officer; or
2-1 (b) A person appointed to serve as a state or local public officer
2-2 during a term to which another person was elected,
2-3 may not become a candidate for a different elected state or local office or
2-4 an elected federal office, unless he first resigns his current state or local
2-5 office.
2-6 2. The provisions of subsection 1 do not apply to a public officer
2-7 whose current term of state or local office will end within 3 months after
2-8 the general election for a different public office for which he becomes a
2-9 candidate.
2-10 Sec. 3. This act becomes effective on July 1, 2001.
