AN ACT relating to physicians; providing for the issuance of a special volunteer medical license to a retired physician to treat indigent persons; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 630 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  A physician who is retired from active practice and who wishes to

1-4  donate his expertise for the medical care and treatment of indigent

1-5  persons in this state may obtain a special volunteer medical license by

1-6  submitting an application to the board pursuant to this section.

1-7    2.  An application for a special volunteer medical license must be on

1-8  a form provided by the board and must include:

1-9    (a) Documentation of the history of medical practice of the physician;

1-10    (b) Proof that the physician previously has been issued an unrestricted

1-11  license to practice medicine in any state of the United States and that he

1-12  has never been the subject of disciplinary action by a medical board in

1-13  any jurisdiction;

1-14    (c) Acknowledgement that the practice of the physician under the

1-15  special volunteer medical license will be exclusively devoted to providing

1-16  medical care to indigent persons in this state; and


2-1    (d) Acknowledgement that the physician will not receive any payment

2-2  or compensation, either direct or indirect, or have the expectation of any

2-3  payment or compensation, for providing medical care under the special

2-4  volunteer medical license.

2-5    3.  If the board finds that the application of a retired physician

2-6  satisfies the requirements of subsection 2 and that the retired physician is

2-7  competent to practice medicine, the board shall issue a special volunteer

2-8  medical license to the retired physician.

2-9    4.  The initial special volunteer medical license issued pursuant to

2-10  this section expires 1 year after the date of issuance. The license may be

2-11  renewed pursuant to this section, and any license that is renewed expires

2-12  2 years after the date of issuance.

2-13    5.  The board shall not charge a fee for:

2-14    (a) The review of an application for a special volunteer medical

2-15  license; or

2-16    (b) The issuance or renewal of a special volunteer medical license

2-17  pursuant to this section.

2-18    6.  A retired physician who is issued a special volunteer medical

2-19  license pursuant to this section and who accepts the privilege of

2-20  practicing medicine in this state pursuant to the provisions of the special

2-21  volunteer medical license shall be deemed to have given his consent to

2-22  the revocation of the special volunteer medical license at any time by the

2-23  board for any of the grounds provided in NRS 630.161 or 630.301 to

2-24  630.3065, inclusive.

2-25    7.  A retired physician who is issued a special volunteer medical

2-26  license pursuant to this section shall comply with the requirements for

2-27  continuing education adopted by the board.

2-28    Sec. 2.  NRS 630.256 is hereby amended to read as follows:

2-29    630.256  1.  If a licensee retires from the practice of medicine, he shall

2-30  notify the board in writing of his intention to retire, and the board shall

2-31  record the fact of retirement. [A] Except as otherwise provided in section

2-32  1 of this act, a licensee who is retired may not engage in the practice of

2-33  medicine. [Any]

2-34    2.  Except as otherwise provided in section 1 of this act, any licensee

2-35  who is retired and desires to return to the practice of medicine, must,

2-36  before resuming the practice of medicine in this state:

2-37    (a) Notify the board of his intent to resume the practice of medicine in

2-38  this state;

2-39    (b) File an affidavit with the board describing his activities during the

2-40  period of his retired status;

2-41    (c) Complete the form for registration for active status;

2-42    (d) Pay the applicable fee for biennial registration; and

2-43    (e) Satisfy the board of his competence to practice medicine.

2-44    [2.] 3. If the board determines that the conduct or competence of the

2-45  registrant during the period of retirement would have warranted denial of

2-46  an application for a license to practice medicine in this state, the board may

2-47  refuse to place the registrant on active status.

2-48    Sec. 3.  This act becomes effective on July 1, 2001.
