AN ACT relating to crimes; increasing the penalty for statutory sexual seduction of a child who is under 14 years of age; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 200.368 is hereby amended to read as follows:
1-2 200.368 1. A person who commits statutory sexual seduction shall
1-3 be punished:
1-4 [1.] (a) If he is 21 years of age or older[,] and:
1-5 (1) The victim is 14 or 15 years of age, for a category C felony as
1-6 provided in NRS 193.130.
1-7 [2.] (2) The victim is under 14 years of age, for a category A felony by
1-8 imprisonment in the state prison for life with the possibility of parole,
1-9 with eligibility for parole beginning when a minimum of 15 years has
1-10 been served, and may be further punished by a fine of not more than
1-11 $10,000.
1-12 (b) If he is under the age of 21 years[,] and:
1-13 (1) The victim is 14 or 15 years of age, for a gross misdemeanor.
1-14 (2) The victim is under 14 years of age, for a category A felony by
1-15 imprisonment in the state prison for life with the possibility of parole,
1-16 with eligibility for parole beginning when a minimum of 15 years has
1-17 been served, and may be further punished by a fine of not more than
1-18 $10,000.
1-19 2. As used in this section, “victim” means a person who is subjected
1-20 to statutory sexual seduction.
2-1 Sec. 2. The amendatory provisions of this act do not apply to offenses
2-2 committed before July 1, 2001.
2-3 Sec. 3. This act becomes effective on July 1, 2001.
