AN ACT relating to the Airport Authority of Washoe County; increasing the number of trustees on the board of trustees of the Airport Authority of Washoe County; requiring the County Fair and Recreation Board of Washoe County to appoint a trustee who represents consumers of services provided at the airport; requiring an appointing authority to appoint persons who have certain qualifications to serve on the board of trustees of the Airport Authority of Washoe County; prohibiting a member of the board from serving more than two terms; limiting the ability of an appointing authority to remove a member of the board; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Section 5 of chapter 474, Statute of Nevada 1977, as last

1-2  amended by chapter 83, Statutes of Nevada 1981, at page 181, is hereby

1-3  amended to read as follows:

1-4  Sec. 5. 1.  The authority shall be directed and governed by a

1-5  board of trustees composed of [eight persons who serve at the

1-6  pleasure of the appointing authority in each case.] nine persons.

1-7  2.  The City of Reno shall be represented on the board by four

1-8  members, the City of Sparks by two members and Washoe County by

1-9  two members, appointed as specified in this section. The terms of all

1-10  trustees appointed by the city councils of the cities of Reno and

1-11  Sparks and the board of county commissioners of Washoe County

1-12  pursuant to this section prior to its amendment expire on July 1, 1981.

1-13  On July 1, 1981:

1-14  (a) The city council of the City of Reno shall appoint four trustees,

1-15  two for terms of 2 years and two for terms of 4 years. Subsequent

1-16  appointments shall be made for terms of 4 years.


2-1  (b) The city council of the City of Sparks shall appoint two

2-2  trustees, one for a term of 2 years and one for a term of 4 years.

2-3  Subsequent appointments shall be made for a term of 4 years.

2-4  (c) The board of county commissioners of Washoe County shall

2-5  appoint two trustees, one for a term of 2 years and one for a term of 4

2-6  years. Subsequent appointments shall be made for terms of 4 years.

2-7  3.  In addition to the members appointed pursuant to subsection

2-8  2, on July 1, 2001, the County Fair and Recreation Board of

2-9  Washoe County shall appoint one trustee who represents consumers

2-10  of services provided at the airport for a term of 4 years. Subsequent

2-11  appointments shall be made for terms of 4 years.

2-12  4.  Each appointing authority:

2-13  (a) Other than the County Fair and Recreation Board of Washoe

2-14  County, shall appoint a person to serve on the board only if the

2-15  appointing authority determines that the person:

2-16            (1) Has experience in the aviation, business or tourism

2-17  industry;

2-18            (2) Has experience in finance or accounting; or

2-19            (3) Possesses such other qualifications that the appointing

2-20  authority determines are necessary or appropriate for carrying out

2-21  the duties of the board; and

2-22  (b) May remove a member of the board which it appointed only if

2-23  the appointing authority determines that the member willfully

2-24  neglected or refused to perform an official duty of the board. An

2-25  appointing authority shall not remove a member for exercising his

2-26  independent judgment.

2-27  5.  A member of the board of trustees shall not serve for more

2-28  than two terms.

2-29  6.  The position of a member of the board of trustees shall be

2-30  considered vacated upon his loss of any of the qualifications required

2-31  for his appointment and in such event the appointing authority shall

2-32  appoint a successor.

2-33    Sec. 2.  Section 7 of chapter 474, Statutes of Nevada 1977, as last

2-34  amended by chapter 737, Statutes of Nevada 1989, at page 1724, is hereby

2-35  amended to read as follows:

2-36  Sec. 7. 1.  The board shall choose one of its members as

2-37  chairman and one of its members as vice chairman, and shall elect a

2-38  secretary and a treasurer, who may be members of the board. The

2-39  secretary and the treasurer may be one person. The terms of the

2-40  officers expire on July 1 of each year.

2-41  2.  Chairmen must be selected from trustees appointed by the

2-42  participating local governments in the following order:

2-43  (a) The City of Reno;

2-44  (b) The City of Sparks; [and]

2-45  (c) Washoe County[.] ; and

2-46  (d) The County Fair and Recreation Board of Washoe County.

2-47  3.  The secretary shall keep, in a well-bound book, a record of all

2-48  of the proceedings of the board, minutes of all meetings, certificates,

2-49  contracts, bonds given by employees, and all other acts of the board.


3-1  The minute book and records must be open to the inspection of all

3-2  interested persons, at all reasonable times and places.

3-3  4.  The treasurer shall keep, in permanent records, strict and

3-4  accurate accounts of all money received by and disbursed for and on

3-5  behalf of the board and the authority. He shall file with the county

3-6  clerk, at authority expense, a corporate fidelity bond in an amount not

3-7  less than $25,000, conditioned for the faithful performance of his

3-8  duties.

3-9    Sec. 3.  Notwithstanding the amendatory provisions of section 1 of this

3-10  act, the members of the board of trustees of the Airport Authority of

3-11  Washoe County currently serving on the board on the effective date of this

3-12  act may continue to serve on the board to the end of their respective terms.

3-13    Sec. 4.  This act becomes effective upon passage and approval.
