AN ACT relating to cancer; creating the task force on prostate cancer; prescribing its powers and duties; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 457 of NRS is hereby amended by adding thereto
1-2 the provisions set forth as sections 2 to 6, inclusive, of this act.
1-3 Sec. 2. As used in sections 2 to 6, inclusive, of this act, “task force”
1-4 means the task force on prostate cancer created pursuant to section 3 of
1-5 this act.
1-6 Sec. 3. 1. The task force on prostate cancer, consisting of 11
1-7 members, is hereby created. The task force consists of:
1-8 (a) The following ex officio members:
1-9 (1) The chief executive officer of Family to Family: Americans for
1-10 Prostate Cancer Awareness and Support;
1-11 (2) The Nevada director of Us Too International, Inc.; and
1-12 (3) The executive officer of the public employees’ benefit program;
1-13 and
1-14 (b) The following members appointed by the governor:
1-15 (1) Two members who are physicians licensed pursuant to chapter
1-16 630 of NRS;
1-17 (2) One member who is an officer or employee of the University and
1-18 Community College System of Nevada;
1-19 (3) One member who is an employee of the bureau of disease
1-20 control and intervention of the health division;
1-21 (4) One member who has had prostate cancer;
2-1 (5) One member who is related to a person who has had prostate
2-2 cancer; and
2-3 (6) Two members who are representatives of business.
2-4 2. If Family to Family: Americans for Prostrate Cancer Awareness
2-5 and Support or Us Too International, Inc., ceases to exist, the highest
2-6 officer or person in charge of any successor organization shall serve as
2-7 the ex officio member required by subparagraph (1) or (2) of paragraph
2-8 (a) of subsection 1 or, if there is no successor organization, the governor
2-9 shall appoint a person to serve pursuant to the applicable subparagraph.
2-10 3. Vacancies of members appointed to the task force must be filled in
2-11 the same manner as original appointments.
2-12 4. The task force shall annually submit a report concerning its
2-13 activities and any recommendations for legislation to the director of the
2-14 legislative counsel bureau for transmittal to the legislature.
2-15 Sec. 4. 1. The member of the task force described in subparagraph
2-16 (1) of paragraph (a) of subsection 1 of section 3 of this act shall serve as
2-17 chairman during even-numbered years and the member described in
2-18 subparagraph (2) of paragraph (a) of subsection 1 of section 3 of this act
2-19 shall serve as chairman during the odd-numbered years.
2-20 2. The members of the task force shall meet at least four times each
2-21 year and at the call of the chairman. The task force shall prescribe
2-22 regulations for its management and government.
2-23 3. Six members of the task force constitute a quorum, and a quorum
2-24 may exercise all the powers conferred on the task force.
2-25 4. After the initial terms, the term of each appointed member of the
2-26 task force is 4 years. The governor shall not appoint a member to serve
2-27 more than two terms.
2-28 5. The members of the task force serve without compensation and
2-29 are not entitled to receive a per diem allowance or travel expenses.
2-30 6. The members of the task force who are state employees must be
2-31 relieved from their duties without loss of their regular compensation to
2-32 perform their duties relating to the task force in the most timely manner
2-33 practicable. The state employees may not be required to make up the time
2-34 they are absent from work to fulfill their obligations as members of the
2-35 task force or take annual leave or compensatory time for the absence.
2-36 Sec. 5. The task force may:
2-37 1. Compile research and information concerning prostate cancer.
2-38 2. Identify and evaluate the methods used by the state and local
2-39 governments to increase the awareness of the general public concerning
2-40 the risk, treatment and prevention of prostate cancer.
2-41 3. Identify and evaluate methods to improve communication among
2-42 institutions and other entities in this state that are involved in the
2-43 research and treatment of prostate cancer.
2-44 4. Identify and evaluate methods to increase funding for institutions
2-45 and other entities in this state that are involved in cancer research.
2-46 5. Identify and evaluate methods to increase the number of men in
2-47 this state who are regularly tested for the presence of prostate cancer.
2-48 6. Identify and evaluate methods to increase the awareness and
2-49 education of the general public concerning prostate cancer.
3-1 7. Apply for any available grants and accept any gifts, grants or
3-2 donations to assist the task force in carrying out its duties pursuant to
3-3 this section.
3-4 Sec. 6. The director of the department of human resources shall
3-5 provide the personnel, facilities, equipment and supplies required by the
3-6 task force to carry out the provisions of sections 2 to 6, inclusive, of this
3-7 act.
3-8 Sec. 7. As soon as practicable after July 1, 2001, the governor shall
3-9 appoint to the task force on prostate cancer created by section 3 of this act:
3-10 1. Four members whose terms expire on June 30, 2004.
3-11 2. Four members whose terms expire on June 30, 2005.
3-12 Sec. 8. This act becomes effective on July 1, 2001.
