AN ACT relating to long-term care; requiring the Aging Services Division of the Department of Human Resources to conduct a study to determine the feasibility of establishing a program for assisted living for low-income persons who are eligible for Medicaid; making an appropriation; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. 1.  The Aging Services Division of the Department of

1-2  Human Resources shall conduct a study to determine the feasibility of

1-3  establishing a program for assisted living for low-income persons who are

1-4  eligible for Medicaid.

1-5    2.  The study must include, without limitation:

1-6    (a) An evaluation of the feasibility of obtaining a waiver from the

1-7  Federal Government to establish such a program within the Medicaid

1-8  program;

1-9    (b) An evaluation of the feasibility of obtaining an amendment to a

1-10  waiver for the Community Home-Based Initiatives Program to establish

1-11  such a program within the Medicaid program;

1-12    (c) An analysis of the availability of financing for the construction of

1-13  facilities for assisted living, including financing from federal programs for

1-14  housing;

1-15    (d) An analysis of the effects such a program would have on the

1-16  Medicaid budget of the Department of Human Resources for long-term

1-17  care and on other programs of the department that provide long-term care;


2-1    (e) An analysis of the types of services that would be offered by such a

2-2  program and the requirements for receiving those services; and

2-3    (f) An analysis of the availability of suitable locations for the

2-4  construction of facilities for assisted living.

2-5    3.  The Aging Services Division of the Department of Human

2-6  Resources shall, not later than October 1, 2002, submit a report of its

2-7  findings and recommendations to the Director of the Legislative Counsel

2-8  Bureau for transmittal to the Legislature.

2-9    Sec. 2.  1.  There is hereby appropriated from the state general fund

2-10  to the Aging Services Division of the Department of Human Resources the

2-11  sum of $100,000 to conduct the study required by section 1 of this act. The

2-12  Aging Services Division may use the money appropriated to hire

2-13  consultants to assist the division in conducting the study.

2-14    2.  Any remaining balance of the appropriation made by subsection 1 of

2-15  this act must not be committed for expenditure after June 30, 2003, and

2-16  reverts to the state general fund as soon as all payments of money

2-17  committed have been made.

2-18    Sec. 3.  This act becomes effective upon passage and approval.
