AN ACT relating to local governments; requiring local governments to comply with certain laws and regulations and to pay certain fees and taxes when providing goods or services in competition with private entities; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 354 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  Notwithstanding any other provision of law, if a local government

1-4  provides goods or services, or both, to the general public in competition

1-5  with a private entity, the local government shall comply with all laws,

1-6  rules and regulations of this state and any other local government with

1-7  which the private entity would be required to comply when providing the

1-8  goods or services from the same location as that of the local government.

1-9    2.  The provisions of subsection 1 apply to all laws, rules and

1-10  regulations of this state or any other local government that require the

1-11  private entity to pay fees, taxes and other charges that the private entity

1-12  must pay as a direct result of providing the goods or services, or both.

1-13  The fees, taxes and other charges required to be paid pursuant to this

1-14  section include all state and local fees, taxes and other charges that

1-15  would be included by the private entity in determining the cost to the

1-16  private entity of providing the good or service.

1-17    3.  If the laws, rules and regulations described in subsections 1 and 2

1-18  would not otherwise apply to the local government but for the provisions

1-19  of subsections 1 and 2, the local government shall comply with the laws,

1-20  rules and regulations in the same manner as if the unit or other

1-21  appropriate division of the local government that includes all the


2-1  employees and equipment involved in providing the goods or services

2-2  were a private business.
