AN ACT relating to the secretary of state; requiring the secretary of state to post a notice advising customers to review the documents on file at the office of the secretary of state for content, completeness and accuracy and indicating the penalty for knowingly offering any false or forged instrument for filing; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 225 of NRS is hereby amended by adding thereto a
1-2 new section to read as follows:
1-3 The secretary of state shall prominently post the following notice at
1-4 each office and each location on his Internet website at which documents
1-5 are accepted for filing:
1-6 The Secretary of State is not responsible for the content,
1-7 completeness or accuracy of any document filed in this office.
1-8 Customers should periodically review the documents on file in this
1-9 office to ensure that the documents pertaining to them are
1-10 complete and accurate.
1-11 Pursuant to NRS 239.330, any person who knowingly offers any
1-12 false or forged instrument for filing in this office is guilty of a
1-13 category C felony and shall be punished by imprisonment in the
1-14 state prison for a minimum term of not less than 1 year and a
1-15 maximum term of not more than 5 years and may be further
1-16 punished by a fine of not more than $10,000. Additionally, any
1-17 person who knowingly offers any false or forged instrument for
1-18 filing in this office may also be subject to civil liability.
2-1 Sec. 2. This act becomes effective upon passage and approval.
