AN ACT relating to pregnancy; providing for the administration of certain activities to prevent or delay early sexual activity and reduce the rate of pregnancies among unmarried teenage girls in Nevada; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. 1.  There is hereby created a state partnership to carry out

1-2  activities throughout the state designed to raise public awareness regarding

1-3  early sexual activity and pregnancies among unmarried teenage girls in

1-4  Nevada.

1-5    2.  The state partnership consists of:

1-6    (a) The administrator of the health division of the department of human

1-7  resources or a person designated by the administrator; and

1-8    (b) The following persons appointed by the administrator:

1-9       (1) One representative of the department of education;

1-10      (2) One person who is employed as a teacher or school counselor in a

1-11  public school in this state;

1-12      (3) One social worker licensed pursuant to chapter 641B of NRS;

1-13      (4) One representative of an agency of juvenile justice in this state;

1-14      (5) One representative of a family court in this state;

1-15      (6) One provider of health care authorized to practice in this state;

1-16      (7) One representative of a faith-based organization;

1-17      (8) One parent who resides in this state, is not employed by the state

1-18  or a local government and is not qualified to be appointed to the state


2-1  partnership pursuant to subparagraphs (1) to (6), inclusive, or (9) of this

2-2  paragraph;

2-3       (9) One person who represents a child-placing agency licensed

2-4  pursuant to NRS 127.250;

2-5       (10) Two persons who represent different populations with high rates

2-6  of teen pregnancy, as determined by the administrator; and

2-7       (11) Not more than two additional persons who possess such

2-8  qualifications as are suitable to carry out the duties of the state partnership.

2-9    3.  The administrator shall appoint the members of the state partnership

2-10  to ensure, as nearly as practicable, that the northern, southern and rural

2-11  areas of the state are equally represented.

2-12    4.  Before appointing the members of the state partnership, the

2-13  administrator shall prepare and cause to be issued notice of the formation

2-14  of the state partnership and solicit the participation of persons who are

2-15  qualified for appointment to the state partnership.

2-16    5.  Any vacancy occurring in the office of a member of the state

2-17  partnership who is appointed pursuant to subparagraphs (1) to (10),

2-18  inclusive, of paragraph (b) of subsection 2 must be filled by the

2-19  administrator by the appointment of a member whose qualifications are the

2-20  same as those of his predecessor in office.

2-21    6.  The members of the state partnership serve without salary, but are

2-22  entitled to receive the per diem allowance and travel expenses provided for

2-23  state officers and employees generally. The per diem allowance and travel

2-24  expenses of a member of the state partnership who is an officer or

2-25  employee of a state agency or a local government must be paid by the state

2-26  agency or local government that employs him.

2-27    Sec. 2.  The state partnership shall, when necessary, obtain assistance

2-28  in carrying out its duties from:

2-29    1.  The appropriate divisions of the department of human resources;

2-30  and

2-31    2.  Appropriate advisory groups, including, without limitation:

2-32    (a) The advisory board on maternal and child health; and

2-33    (b) The governor’s youth advisory council.

2-34    Sec. 3.  1.  The administrator of the health division of the department

2-35  of human resources or a person designated by the administrator shall serve

2-36  as chairman of the state partnership.

2-37    2.  The state partnership:

2-38    (a) Shall meet regularly at the call of the chairman, but not more than

2-39  six times during the biennium beginning on July 1, 2001, and six times

2-40  during the biennium beginning on July 1, 2003.

2-41    (b) Shall meet at least once before each report is submitted to the

2-42  Nevada Legislature pursuant to section 7 of this act, in order to review the

2-43  grants awarded by the state partnership pursuant to section 6 of this act and

2-44  the contents of the reports.

2-45    Sec. 4.  1.  The health division of the department of human resources

2-46  may apply for and receive gifts, grants and donations from any public or

2-47  private source to assist the state partnership in carrying out its duties.

2-48    2.  Any money received by the health division pursuant to this section:

2-49    (a) Must be accounted for separately.


3-1    (b) Must be used, subject to any limitations contained in the gift, grant

3-2  or donation, to carry out the provisions of sections 5 and 6 of this act.

3-3    3.  Any federal money received by the health division pursuant to the

3-4  program to provide temporary assistance for needy families that is

3-5  administered under the Personal Responsibility and Work Opportunity

3-6  Reconciliation Act of 1996 must be expended:

3-7    (a) In accordance with the requirements of that program; and

3-8    (b) For the purposes for which it was received.

3-9    Sec. 5.  The state partnership shall:

3-10    1.  Promote efforts to prevent or delay early sexual activity and reduce

3-11  the rate of pregnancies among unmarried teenage girls in Nevada.

3-12    2.  Cause to be established and promote the recognition of “Teen

3-13  Pregnancy Prevention Month” in Nevada.

3-14    3.  Develop and carry out:

3-15    (a) A social marketing campaign that is designed to prevent or delay

3-16  early sexual activity or reduce the rate of pregnancies among unmarried

3-17  teenage girls in Nevada, or both, and targets populations with the highest

3-18  rates of teen pregnancy.

3-19    (b) A social marketing campaign that is designed to prevent or delay

3-20  early sexual activity or reduce the rate of pregnancies among unmarried

3-21  teenage girls in Nevada, or both, and targets adult and adolescent males.

3-22    Sec. 6.  1.  In addition to carrying out the duties set forth in section 5

3-23  of this act, the state partnership shall develop and carry out a program to

3-24  award grants for the implementation and evaluation of local projects in this

3-25  state. The program must facilitate collaborations between eligible entities,

3-26  and encourage joint applications by eligible entities for the receipt of

3-27  grants. In carrying out the program, the state partnership shall:

3-28    (a) Prepare and issue a request for proposals by eligible entities for the

3-29  implementation and evaluation of local projects.

3-30    (b) Award grants to conduct at least one local project in:

3-31      (1) Clark County;

3-32      (2) Washoe County; and

3-33      (3) Any other county of this state.

3-34    (c) Provide each recipient of a grant with:

3-35      (1) Appropriate technical assistance to facilitate the implementation

3-36  and evaluation of the local project.

3-37      (2) Instruction on the laws of this state that are applicable to the local

3-38  project, including, without limitation, the provisions of NRS 389.065.

3-39    2.  The state partnership shall, as a condition of each grant awarded

3-40  pursuant to this section, require the recipient of the grant to submit to the

3-41  state partnership such reports regarding the use of the money awarded as

3-42  are necessary to ensure that the money is being used for the purposes for

3-43  which it was awarded.

3-44    3.  As used in this section:

3-45    (a) “Eligible entity” means a community-based agency or organization

3-46  in this state involved with youth, the development of youth or the

3-47  prevention of pregnancies among unmarried teenage girls in Nevada.


4-1    (b) “Local project” means a community-based project designed to

4-2  prevent or delay early sexual activity or reduce the rate of pregnancies

4-3  among unmarried teenage girls in Nevada, or both, which:

4-4       (1) Is based upon one or more model programs that have, after

4-5  extensive evaluation, proven to be successful in preventing or delaying

4-6  early sexual activity or reducing the rate of pregnancies among unmarried

4-7  teenage girls in Nevada, or both; or

4-8       (2) Utilizes such innovative techniques and strategies as the state

4-9  partnership determines, upon a showing of sufficient evidence, are likely to

4-10  reduce the rate of pregnancies among unmarried teenage girls in Nevada.

4-11    Sec. 7.  The administrator of the health division of the department of

4-12  human resources shall prepare and submit to the 72nd and 73rd sessions of

4-13  the Nevada Legislature a report on the status of the respective activities

4-14  conducted by the state partnership pursuant to sections 5 and 6 of this act.

4-15  The reports must include, without limitation, an estimate of the number of

4-16  people reached by each activity and the effectiveness of each activity in

4-17  reducing the rate of pregnancies among unmarried teenage girls in Nevada.

4-18    Sec. 8.  1.  The administrator of the health division of the department

4-19  of human resources and the administrator of the welfare division of the

4-20  department of human resources shall, as soon as practicable after the

4-21  effective date of this act, enter into an agreement to transfer to the health

4-22  division money that is available during the biennium beginning on July 1,

4-23  2001, from the program to provide temporary assistance for needy families

4-24  administered under the Personal Responsibility and Work Opportunity

4-25  Reconciliation Act of 1996, to carry out the provisions of this act.

4-26    2.  The agreement must set forth:

4-27    (a) The amount of money from the program that may be expended by

4-28  the health division to carry out the provisions of this act;

4-29    (b) The purposes for which that money may be expended; and

4-30    (c) Any other conditions imposed upon the expenditure of the money.

4-31    Sec. 9.  The administrator of the health division of the department of

4-32  human resources shall, as soon as practicable after the effective date of this

4-33  act, but not later than September 30, 2001, appoint the members of the state

4-34  partnership created pursuant to section 1 of this act.

4-35    Sec. 10.  1.  This act becomes effective upon passage and approval.

4-36    2.  Sections 1 to 6, inclusive, of this act expire by limitation on July 1,

4-37  2005.
