AN ACT relating to physicians; revising the provisions governing the authority of certain physicians to possess, prescribe, dispense and administer controlled substances, dangerous drugs and other drugs; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 453.146 is hereby amended to read as follows:
1-2 453.146 1. The board shall administer the provisions of NRS
1-3 453.011 to 453.552, inclusive, and may add substances to or delete or
1-4 reschedule all substances enumerated in schedules I, II, III, IV and V by
1-5 regulation.
1-6 2. In making a determination regarding a substance, the board shall
1-7 consider the following:
1-8 (a) The actual or relative potential for abuse;
1-9 (b) The scientific evidence of its pharmacological effect, if known;
1-10 (c) The state of current scientific knowledge regarding the substance;
1-11 (d) The history and current pattern of abuse;
1-12 (e) The scope, duration and significance of abuse;
1-13 (f) The risk to the public health;
1-14 (g) The potential of the substance to produce psychic or physiological
1-15 dependence liability; and
1-16 (h) Whether the substance is an immediate precursor of a controlled
1-17 substance.
1-18 3. The board may consider findings of the federal Food and Drug
1-19 Administration or the Drug Enforcement Administration as prima facie
1-20 evidence relating to one or more of the determinative factors.
2-1 4. After considering the factors enumerated in subsection 2 , the board
2-2 shall make findings with respect thereto and , except as otherwise provided
2-3 in NRS 453.221, adopt a regulation controlling the substance if it finds the
2-4 substance has a potential for abuse.
2-5 5. The board shall designate as a controlled substance a steroid or
2-6 other product which is used to enhance athletic performance, muscle mass,
2-7 strength or weight without medical necessity. The board may not designate
2-8 as a controlled substance an anabolic steroid which is:
2-9 (a) Expressly intended to be administered through an implant to cattle,
2-10 poultry or other animals; and
2-11 (b) Approved by the Food and Drug Administration for such use.
2-12 Sec. 2. NRS 453.221 is hereby amended to read as follows:
2-13 453.221 1. The board [may] :
2-14 (a) May adopt regulations and charge reasonable fees relating to the
2-15 registration and control of the dispensing of controlled substances within
2-16 this state.
2-17 (b) Shall not adopt any regulations which in any manner:
2-18 (1) Restrict the authority granted pursuant to subsection 2 of NRS
2-19 453.231 to a physician who holds a license issued pursuant to chapter
2-20 630 or 633 of NRS; or
2-21 (2) Penalize the exercise of that authority.
2-22 2. The board may charge an additional fee for dispensing controlled
2-23 substances included in schedules I to V, inclusive, to cover the cost of
2-24 developing and maintaining the computerized program developed pursuant
2-25 to NRS 453.1545. The amount of the fee must be:
2-26 (a) Set so that the aggregate amount received from the fee does not
2-27 exceed the estimated costs of developing and maintaining the program.
2-28 (b) Approved by the legislature, if it is in regular session, or the interim
2-29 finance committee, if the legislature is not in regular session.
2-30 Sec. 3. NRS 453.231 is hereby amended to read as follows:
2-31 453.231 1. The board shall register an applicant to dispense
2-32 controlled substances included in schedules I to V, inclusive, unless it
2-33 determines that the issuance of that registration would be inconsistent with
2-34 the public interest. In determining the public interest, the board shall
2-35 consider the following factors:
2-36 (a) Maintenance of effective controls against diversion of controlled
2-37 substances into other than legitimate medical, scientific, research or
2-38 industrial channels;
2-39 (b) Compliance with state and local law;
2-40 (c) Promotion of technical advances in the art of manufacturing
2-41 controlled substances and the development of new substances;
2-42 (d) Convictions of the applicant pursuant to laws of another country or
2-43 federal or state laws relating to a controlled substance;
2-44 (e) Past experience of the applicant in the manufacture or distribution of
2-45 controlled substances, and the existence in the applicant’s establishment of
2-46 effective controls against diversion of controlled substances into other than
2-47 legitimate medical, scientific research or industrial channels;
3-1 (f) Furnishing by the applicant of false or fraudulent material in an
3-2 application filed pursuant to the provisions of NRS 453.011 to 453.552,
3-3 inclusive;
3-4 (g) Suspension or revocation of the applicant’s federal registration to
3-5 manufacture, distribute, possess, administer or dispense controlled
3-6 substances as authorized by federal law; and
3-7 (h) Any other factors relevant to and consistent with the public health
3-8 and safety.
3-9 2. [Registration] The registration by the board of a physician who
3-10 holds a license issued pursuant to chapter 630 or 633 of NRS authorizes
3-11 the registrant to possess, prescribe, dispense and administer any
3-12 controlled substance, any dangerous drug as defined in chapter 454 of
3-13 NRS and any other drug for any purpose that the registrant deems to be
3-14 a legitimate medical purpose, except to the extent that his authority to
3-15 possess, prescribe, dispense or administer any controlled substance, any
3-16 dangerous drug as defined in chapter 454 of NRS or any other drug is
3-17 specifically limited by a state or federal statute or federal regulation. The
3-18 board shall not deny, suspend, revoke or limit the registration of a
3-19 physician who holds a license issued pursuant to chapter 630 or 633 of
3-20 NRS or take any other disciplinary action against such a physician who
3-21 is registered by the board solely for his possession, prescription,
3-22 dispensation or administration of a controlled substance, a dangerous
3-23 drug as defined in chapter 454 of NRS or any other drug for any purpose
3-24 that the physician deems to be a legitimate medical purpose, unless the
3-25 particular act of possession, prescription, dispensation or administration
3-26 constitutes a specific violation of a state or federal statute or federal
3-27 regulation.
3-28 3. Except as otherwise provided in subsection 2, registration pursuant
3-29 to subsection 1 entitles a registrant to dispense a substance included in
3-30 schedules I or II only if it is specified in the registration.
3-31 [3.] 4. A practitioner must be registered before dispensing a controlled
3-32 substance or conducting research with respect to a controlled substance
3-33 included in schedules II to V, inclusive. The board need not require
3-34 separate registration pursuant to the provisions of NRS 453.011 to 453.552,
3-35 inclusive, for practitioners engaging in research with nonnarcotic
3-36 controlled substances included in schedules II to V, inclusive, if the
3-37 registrant is already registered in accordance with the provisions of NRS
3-38 453.011 to 453.552, inclusive, in another capacity. A practitioner registered
3-39 in accordance with federal law to conduct research with a substance
3-40 included in schedule I may conduct research with the substance in this state
3-41 upon furnishing the board evidence of the federal registration.
3-42 Sec. 4. NRS 453.521 is hereby amended to read as follows:
3-43 453.521 [It] Except as otherwise authorized pursuant to subsection 2
3-44 of NRS 453.231, it is unlawful for any person within this state to possess,
3-45 sell, offer to sell or hold for the purpose of sale or resale any nasal inhaler
3-46 which contains any controlled substance capable of causing stimulation to
3-47 the central nervous system unless:
3-48 1. The product contains a denaturant in sufficient quantity to render it
3-49 unfit for internal use; and
4-1 2. The product is among such products listed as approved by the board
4-2 in the regulations officially adopted by the board.
4-3 Sec. 5. NRS 454.341 is hereby amended to read as follows:
4-4 454.341 [It] Except as otherwise authorized pursuant to subsection 2
4-5 of NRS 453.231, it is unlawful for any person within this state to possess,
4-6 sell, offer to sell or hold for the purpose of sale or resale any nasal inhaler
4-7 which contains any drug capable of causing stimulation to the central
4-8 nervous system unless:
4-9 1. The product contains a denaturant in sufficient quantity to render it
4-10 unfit for internal use; and
4-11 2. The product is among such products listed as approved for sale
4-12 without restriction by the board in the regulations officially adopted by the
4-13 board.
4-14 Sec. 6. NRS 454.371 is hereby amended to read as follows:
4-15 454.371 1. If the board finds any drug to be dangerous to the public
4-16 health or safety, it may , except as otherwise provided in NRS 453.221,
4-17 adopt a regulation not inconsistent with NRS 454.181 to 454.371,
4-18 inclusive, limiting or restricting the furnishing or dispensing of the drug.
4-19 2. A violation of such a regulation must be punished in the same
4-20 manner as provided in NRS 454.306 to 454.356, inclusive.
4-21 Sec. 7. NRS 630.130 is hereby amended to read as follows:
4-22 630.130 1. In addition to the other powers and duties provided in this
4-23 chapter, the board shall:
4-24 (a) Enforce the provisions of this chapter;
4-25 (b) Establish by regulation standards for licensure under this chapter;
4-26 (c) Conduct examinations for licensure and establish a system of
4-27 scoring for those examinations;
4-28 (d) Investigate the character of each applicant for a license and issue
4-29 licenses to those applicants who meet the qualifications set by this chapter
4-30 and the board; and
4-31 (e) Institute a proceeding in any court to enforce its orders or the
4-32 provisions of this chapter.
4-33 2. The board [may] :
4-34 (a) May adopt such regulations as are necessary or desirable to enable it
4-35 to carry out the provisions of this chapter.
4-36 (b) Shall not adopt any regulations which in any manner:
4-37 (1) Restrict the authority granted to a physician pursuant to
4-38 subsection 2 of NRS 453.231; or
4-39 (2) Penalize the exercise of that authority.
4-40 Sec. 8. NRS 630.3066 is hereby amended to read as follows:
4-41 630.3066 A physician is not subject to disciplinary action solely for
4-42 possessing, prescribing , dispensing or administering [to a patient under his
4-43 care:
4-44 1. Amygdalin (laetrile), if the patient has consented in writing to the
4-45 use of the substance.
4-46 2. Procaine hydrochloride with preservatives and stabilizers (Gerovital
4-47 H3).
4-48 3. A controlled substance which is listed in schedule II, III, IV or V by
4-49 the state board of pharmacy pursuant to NRS 453.146, if the controlled
5-1 substance is lawfully prescribed or administered for the treatment of
5-2 intractable pain in accordance with accepted standards for the practice of
5-3 medicine.] any controlled substance, any dangerous drug as defined in
5-4 chapter 454 of NRS or any other drug in accordance with the authority
5-5 granted to the physician pursuant to subsection 2 of NRS 453.231.
5-6 Sec. 9. NRS 633.291 is hereby amended to read as follows:
5-7 633.291 The board [shall] :
5-8 1. Shall adopt and enforce regulations necessary to enable it to carry
5-9 out its duties under this chapter, including , but not limited to , regulations
5-10 which establish the principles of medical ethics to be used as the basis for
5-11 determining whether conduct which does not constitute malpractice is
5-12 unethical.
5-13 2. Shall not adopt any regulations which in any manner:
5-14 (a) Restrict the authority granted to an osteopathic physician pursuant
5-15 to subsection 2 of NRS 453.231; or
5-16 (b) Penalize the exercise of that authority.
5-17 Sec. 10. NRS 633.521 is hereby amended to read as follows:
5-18 633.521 An osteopathic physician is not subject to disciplinary action
5-19 solely for possessing, prescribing , dispensing or administering [to a
5-20 patient under his care:
5-21 1. Amygdalin (laetrile), if the patient has consented to the use of the
5-22 substance.
5-23 2. Procaine hydrochloride with preservatives and stabilizers (Gerovital
5-24 H3).
5-25 3. A controlled substance which is listed in schedule II, III, IV or V by
5-26 the state board of pharmacy pursuant to NRS 453.146, if the controlled
5-27 substance is lawfully prescribed or administered for the treatment of
5-28 intractable pain in accordance with accepted standards for the practice of
5-29 osteopathic medicine.] any controlled substance, any dangerous drug as
5-30 defined in chapter 454 of NRS or any other drug in accordance with the
5-31 authority granted to the osteopathic physician pursuant to subsection 2
5-32 of NRS 453.231.
5-33 Sec. 11. NRS 639.070 is hereby amended to read as follows:
5-34 639.070 1. [The] Except as otherwise provided in this section and
5-35 NRS 453.221, the board may:
5-36 (a) Adopt such regulations, not inconsistent with the laws of this state,
5-37 as are necessary for the protection of the public, appertaining to the
5-38 practice of pharmacy and the lawful performance of its duties.
5-39 (b) Adopt regulations requiring that prices charged by retail pharmacies
5-40 for drugs and medicines which are obtained by prescription be posted in
5-41 the pharmacies and be given on the telephone to persons requesting such
5-42 information.
5-43 (c) Adopt regulations, not inconsistent with the laws of this state,
5-44 authorizing the secretary of the board to issue certificates, licenses and
5-45 permits required by this chapter and chapters 453 and 454 of NRS . [and
5-46 this chapter.]
5-47 (d) Adopt regulations governing the dispensing of poisons, drugs,
5-48 chemicals and medicines.
5-49 (e) Regulate the practice of pharmacy.
6-1 (f) Regulate the sale and dispensing of poisons, drugs, chemicals and
6-2 medicines.
6-3 (g) Regulate the means of recordkeeping and storage, handling,
6-4 sanitation and security of drugs, poisons, medicines, chemicals and
6-5 devices, including, but not limited to, requirements relating to:
6-6 (1) Pharmacies, institutional pharmacies and pharmacies in
6-7 correctional institutions;
6-8 (2) Drugs stored in hospitals; and
6-9 (3) Drugs stored for the purpose of wholesale distribution.
6-10 (h) Examine and register, upon application, pharmacists and other
6-11 persons who dispense or distribute medications whom it deems qualified.
6-12 (i) Charge and collect necessary and reasonable fees for its services,
6-13 other than those specifically set forth in this chapter.
6-14 (j) Maintain offices in as many localities in the state as it finds
6-15 necessary to carry out the provisions of this chapter.
6-16 (k) Employ an attorney, inspectors, investigators and other professional
6-17 consultants and clerical personnel necessary to the discharge of its duties.
6-18 (l) Enforce the provisions of this chapter, NRS 453.011 to 453.552,
6-19 inclusive, and [enforce the provisions of] chapter 454 of NRS . [and this
6-20 chapter.]
6-21 (m) Adopt regulations concerning the information required to be
6-22 submitted in connection with an application for any license, certificate or
6-23 permit required by this chapter or chapter 453 or 454 of NRS.
6-24 (n) Adopt regulations concerning the education, experience and
6-25 background of a person who is employed by the holder of a license or
6-26 permit issued pursuant to this chapter and who has access to drugs and
6-27 devices.
6-28 (o) Adopt regulations concerning the use of computerized mechanical
6-29 equipment for the filling of prescriptions.
6-30 (p) Participate in and expend money for programs that enhance the
6-31 practice of pharmacy.
6-32 2. [This section does] The provisions of subsection 1 do not authorize
6-33 the board to prohibit open-market competition in the advertising and sale
6-34 of prescription drugs and pharmaceutical services.
6-35 Sec. 12. NRS 630.135 is hereby repealed.
6-36 Sec. 13. As soon as is reasonably practicable, the state board of
6-37 pharmacy, the board of medical examiners and the state board of
6-38 osteopathic medicine shall repeal or amend in such a manner as is
6-39 appropriate to carry out the provisions of this act, the provisions of any
6-40 regulations respectively adopted by the state board of pharmacy, the board
6-41 of medical examiners and the state board of osteopathic medicine before
6-42 the effective date of this section.
6-43 Sec. 14. 1. This section and section 13 of this act become effective
6-44 upon passage and approval.
6-45 2. Sections 1 to 12, inclusive, of this act become effective upon
6-46 passage and approval for the purposes of adopting regulations and
6-47 performing any other preparatory administrative tasks that are necessary to
6-48 carry out the provisions of this act and on October 1, 2001, for all other
6-49 purposes.

7-2 630.135 Board required to define “intractable pain” by regulation.
7-3 The board shall by regulation define the term “intractable pain” for the
7-4 purposes of NRS 630.3066 and 633.521.
