AN ACT relating to state land; requiring the Department of Transportation to convey certain land to the City of Elko; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. The Department of Transportation on behalf of the State of

1-2  Nevada shall convey for no consideration and by quitclaim deed to the City

1-3  of Elko all the right, title and interest of the State of Nevada in and to the

1-4  following adjoining parcels of land, situated in Section 11, Township 34

1-5  North, Range 55 East, M.D.B. & M., in the City of Elko, bordered in part

1-6  by Idaho Street, Convention Drive and Country Club Drive, and more fully

1-7  described by metes and bounds as follows:

1-8    Parcel 1: Beginning at a point (Corner 1) on the Northwesterly right-of-

1-9  way line of Idaho Street bearing South 74°44'35" East from the West

1-10  Quarter corner of Section 11; thence North 58°36' West 568.49 feet to a

1-11  point (Corner 2); thence South 31°24' West 40 feet to a point (Corner 3);

1-12  thence North 58°36' West 227.99 feet to a point (Corner 4); thence North

1-13  0°06'40" West 130.37 feet to a point (Corner 5); thence North 44°53'20"

1-14  East 120 feet to a point (Corner 6); thence North 89°53'20" East 90.14 feet

1-15  along the Quarter Section line to a point (Corner 7); thence North 0°03'19"

1-16  East 80 feet to a point (Corner 8); thence North 89°53'20" East 489.3 feet

1-17  to a point on the West boundary of the E 1/2 E 1/2 NW 1/4 of Section 11

1-18  (Corner 9); thence South 0°03'19" West along the West boundary of the E

1-19  1/2 E 1/2 NW 1/4 of Section 11, 80 feet to a point on the Quarter Section

1-20  line (Corner 10); thence North 89°53'20" East 401.79 feet to a point on the

1-21  Northwesterly 75' right-of-way line of Idaho Street (Corner 11); thence

1-22  South 31°24' West along the right-of-way line 660.11 feet to the Place of

1-23  Beginning (Corner 1), containing 9.181 acres of land more or less.


2-1    Parcel 2: Beginning at a point bearing South 80°18'57" East 1348.41

2-2  feet from the West Quarter corner of Section 11; thence South 58°36' East

2-3  569.3 feet to a point; thence South 31°24' West 410 feet to a point; thence

2-4  North 58°36' West 569.3 feet to a point; thence North 31°24' East 410 feet

2-5  to the Place of Beginning, containing 5.36 acres more or less.

2-6    Sec. 2.  The Department of Transportation shall include in its

2-7  conveyance, to the extent not included within the descriptions in section 1

2-8  of this act, any abandoned right of way of a public street adjacent to either

2-9  parcel.

2-10    Sec. 3.  The conveyance required by section 1 of this act, and the

2-11  descriptions included in that section, are subject to any easement not

2-12  abandoned which exists on the date of the conveyance, whether or not of

2-13  record. The provisions of NRS 408.533 do not apply to the conveyance so

2-14  required.

2-15    Sec. 4.  This act becomes effective upon passage and approval.
