AN ACT relating to the Airport Authority of Washoe County; revising the provisions governing the appointment of the members of the board of trustees; prohibiting a former member of the board from entering into, bidding on or having a pecuniary interest in a contract with the authority or being employed by the authority until 1 year after the termination of his service on the board; exempting the Authority from certain requirements concerning concession agreements; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Section 5 of chapter 474, Statutes of Nevada 1977, as last

1-2  amended by chapter 83, Statutes of Nevada 1981, at page 181, is hereby

1-3  amended to read as follows:

1-4    Sec. 5.  1.  The authority [shall] must be directed and governed

1-5  by a board of trustees composed of eight persons who serve at the

1-6  pleasure of the appointing authority in each case.

1-7    2.  The City of Reno [shall] must be represented on the board by

1-8  four members, the City of Sparks by two members and Washoe

1-9  County by two members, appointed as specified in this section. The

1-10  terms of all trustees appointed by the city councils of the cities of

1-11  Reno and Sparks and the board of county commissioners of Washoe

1-12  County pursuant to this section [prior to] before its amendment expire

1-13  on July 1, 1981. On July 1, 1981:

1-14  (a) The city council of the City of Reno shall appoint four trustees,

1-15  two for terms of 2 years and two for terms of 4 years. Subsequent

1-16  appointments [shall] must be made for terms of 4 years.


2-1    (b) The city council of the City of Sparks shall appoint two

2-2  trustees, one for a term of 2 years and one for a term of 4 years.

2-3  Subsequent appointments [shall] must be made for a term of 4 years.

2-4    (c) The board of county commissioners of Washoe County shall

2-5  appoint two trustees, one for a term of 2 years and one for a term of 4

2-6  years. Subsequent appointments [shall] must be made for terms of 4

2-7  years.

2-8    3.  The position of a member of the board of trustees [shall] must

2-9  be considered vacated upon his loss of any of the qualifications

2-10  required for his appointment and in such event the appointing

2-11  authority shall appoint a successor.

2-12  4.  An appointment of a member of the board of trustees

2-13  pursuant to the provisions of this section must be made not later

2-14  than June 15 of the year in which the member is required to be

2-15  appointed.

2-16  Sec. 2.  Section 6 of chapter 474, Statutes of Nevada 1977, as last

2-17  amended by chapter 186, Statutes of Nevada 1995, at page 310, is hereby

2-18  amended to read as follows:

2-19      Sec. 6. 1.  Each member of the board shall file with the county

2-20  clerk:

2-21      (a) His oath of office.

2-22      (b) A corporate surety bond furnished at the authority’s expense, in

2-23  an amount not to exceed $5,000, and conditioned for the faithful

2-24  performance of his duties as a member of the board.

2-25      2.  No member of the board, during his term thereon, may hold

2-26  any elective office, have any financial interest in the aviation industry

2-27  or have a financial interest in any contract or other transaction with

2-28  the board or the authority other than as that contract or transaction

2-29  may be made available to a member of the general public in the

2-30  course of the authority’s business.

2-31      3.  Each member of the board is entitled to receive $560 per

2-32  month.

2-33      4.  A former member of the board may not:

2-34      (a) Enter into, submit a bid for or have a pecuniary interest in a

2-35  contract with the authority; or

2-36      (b) Be employed by the authority,

2-37  until 1 year after the termination of his service on the board.

2-38      5.  For the purposes of this section, “financial interest” means:

2-39      (a) Ownership of 10 percent or more of the capital stock or assets

2-40  of any business entity, directly or through a member of the interested

2-41  person’s household.

2-42      (b) Income amounting to 10 percent or more of the gross income of

2-43  the interested person.

2-44    Sec. 3.  Section 10.2 of chapter 737, Statutes of Nevada 1989, as last

2-45  amended by chapter 614, Statutes of Nevada 1993, at page 2554, is hereby

2-46  amended to read as follows:

2-47  Sec. 10.2  1.  The authority may enter into any concession

2-48  agreement if the board or its authorized representative reviews the

2-49  agreement and determines it is in the best interest of the authority. In


3-1  making [this] that determination, the board or its authorized

3-2  representative shall consider whether the proposed fees to be paid to

3-3  the authority for the privileges granted are conducive to revenue

3-4  generation and providing high quality service to the traveling public.

3-5    2.  Before entering into any concession agreement providing

3-6  estimated revenue to the authority of more than $25,000, the authority

3-7  must:

3-8    (a) Comply with the bidding requirements of the Local

3-9  Government Purchasing Act[;] except the provisions of subsection 3

3-10  of NRS 332.105; or

3-11  (b) Publish notice of its intention to enter the agreement in a

3-12  newspaper of general circulation in the county at least three times

3-13  during a period of 10 days. The notice must specify the date, time and

3-14  place of a regular meeting of the authority to be held after completion

3-15  of the publication at which any interested person may appear.

3-16  3.  The board may authorize the executive director of the authority

3-17  to enter into any concession agreement on behalf of the authority if

3-18  the agreement provides estimated revenue to the authority of $25,000

3-19  or less. Such an agreement is not subject to the provisions of

3-20  subsection 2.

3-21    Sec. 4.  The prohibition set forth in subsection 4 of section 6 of chapter

3-22  474, Statutes of Nevada 1977, as last amended by section 2 of this act,

3-23  applies to members of the board of trustees of the Airport Authority of

3-24  Washoe County who are serving on or after July 1, 2001.

3-25    Sec. 5.  This act becomes effective on July 1, 2001.
