AN ACT relating to education; creating the Western Interstate Commission for Higher Education scholarship trust fund; providing for the award of scholarships from the fund to certain students; making an appropriation; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 397 of NRS is hereby amended by adding thereto a
1-2 new section to read as follows:
1-3 1. The Western Interstate Commission for Higher Education
1-4 scholarship trust fund is hereby created, to be administered by the three
1-5 commissioners from the State of Nevada, acting jointly. The
1-6 commissioners may accept gifts, grants, bequests and donations for
1-7 deposit in the fund. All money received from persons who are required to
1-8 repay a scholarship pursuant to subsection 5 must be deposited in the
1-9 fund.
1-10 2. The money in the fund remains in the fund and does not revert to
1-11 the state general fund at the end of any fiscal year.
1-12 3. The money in the fund must be used solely to provide scholarships
1-13 to students who are certified to study to practice in a profession which
1-14 could benefit an underserved area of this state. Within the limits of
1-15 money available in the fund, each year at least:
1-16 (a) Five scholarships must be awarded for the nursing profession;
1-17 (b) Five scholarships must be awarded for the mental health
1-18 profession; and
1-19 (c) Five scholarships must be awarded for the teaching
1-20 profession.
2-1 The three commissioners from the State of Nevada, acting jointly, may
2-2 award additional scholarships to persons in other professions which
2-3 could benefit an underserved area of this state.
2-4 4. As a condition for receipt of a scholarship, a student must agree to
2-5 practice for at least 1 year in an underserved area of this state in the
2-6 profession in which he is certified to study. The terms and conditions of
2-7 the scholarship, including, without limitation, the terms and conditions
2-8 for repayment of the scholarship, must be set forth in a contract between
2-9 the student and the grantor.
2-10 5. If a student who receives a scholarship does not practice for at
2-11 least 1 year in an underserved area of this state in the profession in
2-12 which he was certified to study, the student shall repay the scholarship
2-13 subject to the terms and conditions prescribed pursuant to subsection 6.
2-14 6. The three commissioners from the State of Nevada, acting jointly:
2-15 (a) Shall adopt regulations that prescribe the terms and conditions for
2-16 repayment of a scholarship if a student fails to practice for at least 1 year
2-17 in an underserved area of this state in the profession in which he was
2-18 certified to study.
2-19 (b) May adopt such regulations as are necessary to carry out the
2-20 provisions of this section.
2-21 7. As used in this section, “profession which could benefit an
2-22 underserved area in this state” includes, without limitation, nursing,
2-23 mental health and teaching.
2-24 Sec. 2. 1. There is hereby appropriated from the state general fund
2-25 to the Western Interstate Commission for Higher Education scholarship
2-26 trust fund created pursuant to section 1 of this act for the 2002-2003 fiscal
2-27 year, the sum of $75,000.
2-28 2. The three commissioners from the State of Nevada, acting jointly,
2-29 shall use the money appropriated by subsection 1 to provide scholarships to
2-30 students pursuant to section 1 of this act.
2-31 Sec. 3. 1. This section becomes effective on July 1, 2001.
2-32 2. Section 1 of this act becomes effective on July 1, 2001, for the
2-33 purpose of adopting regulations and on July 1, 2002, for all other purposes.
2-34 3. Section 2 of this act becomes effective on July 1, 2002.
