AN ACT relating to nursing; prohibiting the state board of nursing or an employer of a nurse from requiring the inclusion of the surname of the nurse on the badge or other form of identification worn by the nurse while on duty; requiring the employers of licensees and nursing assistants to prepare and maintain records of the work assignments of those licensees and nursing assistants for a certain period; revising the provisions governing the filing of complaints with the state board of nursing; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 632 of NRS is hereby amended by adding thereto

1-2  the provisions set forth as sections 2 and 3 of this act.

1-3    Sec. 2. The board, or a medical facility or any other person who

1-4  employs a licensee, shall not require a licensee while on duty, to wear a

1-5  badge or other form of identification that includes the surname of the

1-6  licensee.

1-7    Sec. 3. Each employer of a licensee or nursing assistant shall

1-8  prepare and maintain, for at least 5 years, a record of the work

1-9  assignments of each licensee or nursing assistant.

1-10    Sec. 4. NRS 632.125 is hereby amended to read as follows:

1-11    632.125  1.  Each hospital or agency in the state employing

1-12  professional or practical nurses or nursing assistants shall submit alist of

1-13  such nursing personnel to the board at least three times annually as directed

1-14  by the board. Each list submitted to the board pursuant to this subsection

1-15  is confidential.

1-16    2.  A medical facility shall, before hiring a nursing assistant or nursing

1-17  assistant trainee, obtain validation from the board that the prospective

1-18  employee has a current certificate, is enrolled in a training program

1-19  required for certification or is awaiting the results of a certification

1-20  examination.


2-1    Sec. 5. NRS 632.310 is hereby amended to read as follows:

2-2    632.310  1.  The board may, upon its own motion, and shall, upon the

2-3  verified complaint in writing of any person, if the complaint alone or

2-4  together with evidence, documentary or otherwise, presented in connection

2-5  therewith, is sufficient to require an investigation, investigate the actions of

2-6  any licensee or holder of a certificate or any person who assumes to act as

2-7  a licensee or holder of a certificate within the State of Nevada.

2-8    2.  The executive director may, upon receipt of information from a

2-9  governmental agency, conduct an investigation to determine whether the

2-10  information is sufficient to require an investigation for referral to the board

2-11  for its consideration.

2-12    3.  If a written verified complaint filed with the board does not

2-13  include the complete name of the licensee or nursing assistant against

2-14  whom the complaint is filed, and the board is unable to identify the

2-15  licensee or nursing assistant, the board shall request that the employer of

2-16  the licensee or nursing assistant provide to the board the complete name

2-17  of the licensee or nursing assistant. The employer shall provide the name

2-18  to the board within 3 business days after the request is made.

2-19    4.  The employer of a licensee or nursing assistant shall provide to

2-20  the board, upon its request, the record of the work assignments of any

2-21  licensee or nursing assistant whose actions are under investigation by the

2-22  board.

2-23    Sec. 6.  This act becomes effective on July 1, 2001.
