AN ACT relating to motor vehicles; providing for the limited issuance of special license plates to commemorate the 100th anniversary of the founding of the City of Las Vegas; imposing a fee for the issuance or renewal of such license plates; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 482 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  Except as otherwise provided in this subsection and subsection 7,

1-4  the department, in cooperation with the board of museums and history of

1-5  the department of museums, library and arts, shall design, prepare and

1-6  issue license plates which commemorate the 100th anniversary of the

1-7  founding of the City of Las Vegas, using any colors and designs that the

1-8  department deems appropriate. The department shall not design, prepare

1-9  or issue the commemorative license plates unless it receives at least 250

1-10  applications for the issuance of those plates.

1-11    2.  Except as otherwise provided in subsection 7, if the department

1-12  receives at least 250 applications for the issuance of the commemorative

1-13  license plates, the department shall issue those plates for a passenger car

1-14  or light commercial vehicle upon application by a person who is entitled

1-15  to license plates pursuant to NRS 482.265 and who otherwise complies

1-16  with the requirements for registration and licensing pursuant to this


2-1  chapter. A person may request that personalized prestige license plates

2-2  issued pursuant to NRS 482.3667 be combined with the commemorative

2-3  license plates if that person pays the fees for the personalized prestige

2-4  license plates in addition to the fees for the commemorative license plates

2-5  pursuant to subsections 3 and 4.

2-6    3.  The fee for the commemorative license plates is $35, in addition to

2-7  all other applicable registration and license fees and motor vehicle

2-8  privilege taxes. The license plates are renewable upon the payment of

2-9  $10.

2-10    4.  Except as otherwise provided in this subsection, in addition to all

2-11  other applicable registration and license fees and motor vehicle privilege

2-12  taxes and the fee prescribed in subsection 3, a person who requests a set

2-13  of the commemorative license plates must pay for the initial issuance of

2-14  the plates an additional fee of $25 and for each renewal of the plates an

2-15  additional fee of $20, to be distributed pursuant to subsection 5. The

2-16  additional fees required pursuant to this subsection must not be charged

2-17  after December 31, 2005.

2-18    5.  The department shall deposit the fees collected pursuant to

2-19  subsection 4 with the state treasurer for credit to the state general fund.

2-20  For the duration of the collection of such fees, the state treasurer shall,

2-21  on a quarterly basis, distribute the fees to the city treasurer of the City of

2-22  Las Vegas to be used to pay for:

2-23    (a) A celebration of the 100th anniversary of the founding of the City

2-24  of Las Vegas to be held in 2005; and

2-25    (b) Projects relating to the commemoration of the history of the City

2-26  of Las Vegas, including, without limitation, historical markers, tours of

2-27  historic sites and improvements to or restoration of historic buildings or

2-28  structures.

2-29    6.  If, during a registration year, the holder of the commemorative

2-30  license plates disposes of the vehicle to which the commemorative license

2-31  plates are affixed, the holder shall:

2-32    (a) Retain the commemorative license plates and affix them to another

2-33  vehicle that meets the requirements of this section if the transfer and

2-34  registration fees are paid as set forth in this chapter; or

2-35    (b) Within 30 days after removing the commemorative license plates

2-36  from the vehicle, return them to the department.

2-37    7.  The department shall not issue:

2-38    (a) The commemorative license plates after December 31, 2005.

2-39    (b) Replacement license plates for those license plates after December

2-40  31, 2010.

2-41    Sec. 2.  NRS 482.216 is hereby amended to read as follows:

2-42    482.216  1.  Upon the request of a new vehicle dealer, the department

2-43  may authorize the new vehicle dealer to:

2-44    (a) Accept applications for the registration of the new motor vehicles he

2-45  sells and the related fees and taxes;

2-46    (b) Issue certificates of registration to applicants who satisfy the

2-47  requirements of this chapter; and


3-1    (c) Accept applications for the transfer of registration pursuant to NRS

3-2  482.399 if the applicant purchased from the new vehicle dealer a new

3-3  vehicle to which the registration is to be transferred.

3-4    2.  A new vehicle dealer who is authorized to issue certificates of

3-5  registration pursuant to subsection 1 shall:

3-6    (a) Transmit the applications he receives to the department within the

3-7  period prescribed by the department;

3-8    (b) Transmit the fees he collects from the applicants and properly

3-9  account for them within the period prescribed by the department;

3-10    (c) Comply with the regulations adopted pursuant to subsection 4; and

3-11    (d) Bear any cost of equipment which is necessary to issue certificates

3-12  of registration, including any computer hardware or software.

3-13    3.  A new vehicle dealer who is authorized to issue certificates of

3-14  registration pursuant to subsection 1 shall not:

3-15    (a) Charge any additional fee for the performance of those services;

3-16    (b) Receive compensation from the department for the performance of

3-17  those services;

3-18    (c) Accept applications for the renewal of registration of a motor

3-19  vehicle; or

3-20    (d) Accept an application for the registration of a motor vehicle if the

3-21  applicant wishes to:

3-22      (1) Obtain special license plates pursuant to NRS 482.3667 to

3-23  482.3825, inclusive[;] , and section 1 of this act; or

3-24      (2) Claim the exemption from the vehicle privilege tax provided

3-25  pursuant to NRS 361.1565 to veterans and their relations.

3-26    4.  The director shall adopt such regulations as are necessary to carry

3-27  out the provisions of this section. The regulations adopted pursuant to this

3-28  subsection must provide for:

3-29    (a) The expedient and secure issuance of license plates and decals by

3-30  the department; and

3-31    (b) The withdrawal of the authority granted to a new vehicle dealer

3-32  pursuant to subsection 1 if that dealer fails to comply with the regulations

3-33  adopted by the department.

3-34    Sec. 3.  NRS 482.500 is hereby amended to read as follows:

3-35    482.500  1.  Except as otherwise provided in subsection 2 or 3,

3-36  whenever upon application any duplicate or substitute certificate of

3-37  registration, decal or number plate is issued, the following fees must be

3-38  paid:

 

3-39    For a certificate of registration...................... $5.00

3-40    For every substitute number plate or set of plates   5.00

3-41    For every duplicate number plate or set of plates   10.00

3-42    For every decal displaying a county name......    .50

3-43    For every other decal, license plate sticker or tab   5.00

 

3-44    2.  The following fees must be paid for any replacement plate or set of

3-45  plates issued for the following special license plates:


4-1    (a) For any special plate issued pursuant to NRS 482.3667, 482.3672,

4-2  482.3675, 482.370 to 482.376, inclusive, or 482.379 to 482.3816,

4-3  inclusive, and section 1 of this act, a fee of $10.

4-4    (b) For any special plate issued pursuant to NRS 482.368, 482.3765,

4-5  482.377 or 482.378, a fee of $5.

4-6    (c) For any souvenir license plate issued pursuant to NRS 482.3825 or

4-7  sample license plate issued pursuant to NRS 482.2703, a fee equal to that

4-8  established by the director for the issuance of those plates.

4-9    3.  A fee must not be charged for a duplicate or substitute of a decal

4-10  [requested] issued pursuant to NRS 482.37635.

4-11    4.  The fees which are paid for duplicate number plates and decals

4-12  displaying county names must be deposited with the state treasurer for

4-13  credit to the motor vehicle fund and allocated to the department to defray

4-14  the costs of duplicating the plates and manufacturing the decals.

4-15    5.  As used in this section:

4-16    (a) “Duplicate number plate” means a license plate or a set of license

4-17  plates issued to a registered owner which repeat the code of a plate or set of

4-18  plates previously issued to the owner to maintain his registration using the

4-19  same code.

4-20    (b) “Substitute number plate” means a license plate or a set of license

4-21  plates issued in place of a previously issued and unexpired plate or set of

4-22  plates. The plate or set of plates does not repeat the code of the previously

4-23  issued plate or set.

4-24    Sec. 4.  On or before October 1, 2003, the department of motor

4-25  vehicles and public safety shall determine and publicly declare the number

4-26  of applications it has received for the issuance of license plates pursuant to

4-27  section 1 of this act.

4-28    Sec. 5.  The amendatory provisions of this act expire by limitation on

4-29  October 1, 2003, if on that date the department of motor vehicles and

4-30  public safety has received fewer than 250 applications for the issuance of

4-31  license plates pursuant to section 1 of this act.
