AN ACT relating to motor vehicles; providing for the limited issuance of special license plates to commemorate the 100th anniversary of the founding of the City of Las Vegas; imposing a fee for the issuance or renewal of such license plates; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 482 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  Except as otherwise provided in this subsection and subsection 7,

1-4  the department, in cooperation with the board of museums and history of

1-5  the department of museums, library and arts, shall design, prepare and

1-6  issue license plates which commemorate the 100th anniversary of the

1-7  founding of the City of Las Vegas, using any colors and designs that the

1-8  department deems appropriate. The department shall not design, prepare

1-9  or issue the commemorative license plates unless it receives at least 250

1-10  applications for the issuance of those plates.

1-11    2.  Except as otherwise provided in subsection 7, if the department

1-12  receives at least 250 applications for the issuance of the commemorative

1-13  license plates, the department shall issue those plates for a passenger car

1-14  or light commercial vehicle upon application by a person who is entitled

1-15  to license plates pursuant to NRS 482.265 and who otherwise complies

1-16  with the requirements for registration and licensing pursuant to this


2-1  chapter. A person may request that personalized prestige license plates

2-2  issued pursuant to NRS 482.3667 be combined with the commemorative

2-3  license plates if that person pays the fees for the personalized prestige

2-4  license plates in addition to the fees for the commemorative license plates

2-5  pursuant to subsections 3 and 4.

2-6    3.  The fee for the commemorative license plates is $35, in addition to

2-7  all other applicable registration and license fees and governmental

2-8  services taxes. The license plates are renewable upon the payment of $10.

2-9    4.  Except as otherwise provided in this subsection, in addition to all

2-10  other applicable registration and license fees and governmental services

2-11  taxes and the fee prescribed in subsection 3, a person who requests a set

2-12  of the commemorative license plates must pay for the initial issuance of

2-13  the plates an additional fee of $25 and for each renewal of the plates an

2-14  additional fee of $20, to be distributed pursuant to subsection 5. The

2-15  additional fees required pursuant to this subsection must not be charged

2-16  after December 31, 2005.

2-17    5.  The department shall deposit the fees collected pursuant to

2-18  subsection 4 with the state treasurer for credit to the state general fund.

2-19  For the duration of the collection of such fees, the state treasurer shall,

2-20  on a quarterly basis, distribute the fees to the city treasurer of the City of

2-21  Las Vegas to be used to pay for:

2-22    (a) A celebration of the 100th anniversary of the founding of the City

2-23  of Las Vegas to be held in 2005; and

2-24    (b) Projects relating to the commemoration of the history of the City

2-25  of Las Vegas, including, without limitation, historical markers, tours of

2-26  historic sites and improvements to or restoration of historic buildings or

2-27  structures.

2-28    6.  If, during a registration year, the holder of the commemorative

2-29  license plates disposes of the vehicle to which the commemorative license

2-30  plates are affixed, the holder shall:

2-31    (a) Retain the commemorative license plates and affix them to another

2-32  vehicle that meets the requirements of this section if the transfer and

2-33  registration fees are paid as set forth in this chapter; or

2-34    (b) Within 30 days after removing the commemorative license plates

2-35  from the vehicle, return them to the department.

2-36    7.  The department shall not issue:

2-37    (a) The commemorative license plates after December 31, 2005.

2-38    (b) Replacement license plates for those license plates after December

2-39  31, 2010.

2-40    Sec. 2.  NRS 482.216 is hereby amended to read as follows:

2-41    482.216  1.  Upon the request of a new vehicle dealer, the department

2-42  may authorize the new vehicle dealer to:

2-43    (a) Accept applications for the registration of the new motor vehicles he

2-44  sells and the related fees and taxes;

2-45    (b) Issue certificates of registration to applicants who satisfy the

2-46  requirements of this chapter; and

2-47    (c) Accept applications for the transfer of registration pursuant to NRS

2-48  482.399 if the applicant purchased from the new vehicle dealer a new

2-49  vehicle to which the registration is to be transferred.


3-1    2.  A new vehicle dealer who is authorized to issue certificates of

3-2  registration pursuant to subsection 1 shall:

3-3    (a) Transmit the applications he receives to the department within the

3-4  period prescribed by the department;

3-5    (b) Transmit the fees he collects from the applicants and properly

3-6  account for them within the period prescribed by the department;

3-7    (c) Comply with the regulations adopted pursuant to subsection 4; and

3-8    (d) Bear any cost of equipment which is necessary to issue certificates

3-9  of registration, including any computer hardware or software.

3-10    3.  A new vehicle dealer who is authorized to issue certificates of

3-11  registration pursuant to subsection 1 shall not:

3-12    (a) Charge any additional fee for the performance of those services;

3-13    (b) Receive compensation from the department for the performance of

3-14  those services;

3-15    (c) Accept applications for the renewal of registration of a motor

3-16  vehicle; or

3-17    (d) Accept an application for the registration of a motor vehicle if the

3-18  applicant wishes to:

3-19      (1) Obtain special license plates pursuant to NRS 482.3667 to

3-20  482.3825, inclusive[;] , and section 1 of this act; or

3-21      (2) Claim the exemption from the governmental services tax provided

3-22  pursuant to NRS 361.1565 to veterans and their relations.

3-23    4.  The director shall adopt such regulations as are necessary to carry

3-24  out the provisions of this section. The regulations adopted pursuant to this

3-25  subsection must provide for:

3-26    (a) The expedient and secure issuance of license plates and decals by

3-27  the department; and

3-28    (b) The withdrawal of the authority granted to a new vehicle dealer

3-29  pursuant to subsection 1 if that dealer fails to comply with the regulations

3-30  adopted by the department.

3-31    Sec. 3.  NRS 482.500 is hereby amended to read as follows:

3-32    482.500  1.  Except as otherwise provided in subsection 2 or 3,

3-33  whenever upon application any duplicate or substitute certificate of

3-34  registration, decal or number plate is issued, the following fees must be

3-35  paid:

 

3-36    For a certificate of registration...................... $5.00

3-37    For every substitute number plate or set of plates   5.00

3-38    For every duplicate number plate or set of plates   10.00

3-39    For every decal displaying a county name......    .50

3-40    For every other decal, license plate sticker or tab   5.00

 

3-41    2.  The following fees must be paid for any replacement plate or set of

3-42  plates issued for the following special license plates:

3-43    (a) For any special plate issued pursuant to NRS 482.3667, 482.3672,

3-44  482.3675, 482.370 to 482.376, inclusive, or 482.379 to 482.3816,

3-45  inclusive, and section 1 of this act, a fee of $10.

3-46    (b) For any special plate issued pursuant to NRS 482.368, 482.3765,

3-47  482.377 or 482.378, a fee of $5.


4-1    (c) For any souvenir license plate issued pursuant to NRS 482.3825 or

4-2  sample license plate issued pursuant to NRS 482.2703, a fee equal to that

4-3  established by the director for the issuance of those plates.

4-4    3.  A fee must not be charged for a duplicate or substitute of a decal

4-5  [requested] issued pursuant to NRS 482.37635.

4-6    4.  The fees which are paid for duplicate number plates and decals

4-7  displaying county names must be deposited with the state treasurer for

4-8  credit to the motor vehicle fund and allocated to the department to defray

4-9  the costs of duplicating the plates and manufacturing the decals.

4-10    5.  As used in this section:

4-11    (a) “Duplicate number plate” means a license plate or a set of license

4-12  plates issued to a registered owner which repeat the code of a plate or set of

4-13  plates previously issued to the owner to maintain his registration using the

4-14  same code.

4-15    (b) “Substitute number plate” means a license plate or a set of license

4-16  plates issued in place of a previously issued and unexpired plate or set of

4-17  plates. The plate or set of plates does not repeat the code of the previously

4-18  issued plate or set.

4-19    Sec. 4.  On or before October 1, 2003, the department of motor

4-20  vehicles and public safety shall determine and publicly declare the number

4-21  of applications it has received for the issuance of license plates pursuant to

4-22  section 1 of this act.

4-23    Sec. 5.  The amendatory provisions of this act expire by limitation on

4-24  October 1, 2003, if on that date the department of motor vehicles and

4-25  public safety has received fewer than 250 applications for the issuance of

4-26  license plates pursuant to section 1 of this act.

 

4-27  H
