AN ACT relating to the Department of Transportation; requiring the Legislative Auditor to conduct an audit of the Department of Transportation and the Board of Directors of the Department; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. 1.  The Legislative Auditor shall conduct an audit of the

1-2  Department of Transportation and the Board of Directors of the

1-3  Department.

1-4    2.  The audit must include, without limitation, an assessment of:

1-5    (a) The procedures used to develop and adopt short-term and long-term

1-6  plans for projects, including an evaluation of the criteria used to:

1-7       (1) Select projects by category;

1-8       (2) Select projects among projects within a category; and

1-9       (3) Determine the appropriate financing for projects.

1-10    (b) The management of the real property of the Department, including,

1-11  without limitation:

1-12      (1) Rights of way;

1-13      (2) Real property designated for expansion of public highways, roads

1-14  and other facilities; and

1-15      (3) Surplus property and the procedure for the disposition of that

1-16  property.

1-17    3.  The Legislative Auditor shall:

1-18    (a) Prepare a final written report of the audit not later than February 3,

1-19  2003;


2-1    (b) Present the final written report to the Senate Standing Committee on

2-2  Transportation and the Assembly Standing Committee on Transportation;

2-3  and

2-4    (c) After presentation of the final written report pursuant to paragraph

2-5  (b), present the final written report to the Audit Subcommittee of the

2-6  Legislative Commission and the Legislative Commission.

2-7    Sec. 2.  1.  Upon the request of the Legislative Auditor, the

2-8  Department of Transportation shall transfer from its budget to the Audit

2-9  Division of the Legislative Counsel Bureau the sum of $10,000 to carry out

2-10  the provisions of section 1 of this act.

2-11    2.  Any remaining balance of the sum transferred pursuant to

2-12  subsection 1 must not be committed for expenditure after February 3, 2003,

2-13  and reverts to the state highway fund as soon as all payments of money

2-14  committed have been made.

2-15    Sec. 3.  This act becomes effective on July 1, 2001.
