AN ACT relating to occupational licensing boards; requiring each occupational licensing board to submit a quarterly summary of disciplinary actions and a biennial report of its activities to the director of the legislative counsel bureau; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Title 54 of NRS is hereby amended by adding thereto a

1-2  new chapter to consist of the provisions set forth as sections 2, 3 and 4 of

1-3  this act.

1-4    Sec. 2.  As used in this chapter, unless the context otherwise

1-5  requires, “occupational licensing board” includes, without limitation:

1-6    1.  The state board of architecture, interior design and residential

1-7  design.

1-8    2.  The board of landscape architecture.

1-9    3.  The state contractors’ board.

1-10    4.  The state board of professional engineers and land surveyors.

1-11    5.  The board of registered environmental health specialists.

1-12    6.  The Nevada state board of accountancy.

1-13    7.  The board of medical examiners.

1-14    8.  The board of homeopathic medical examiners.

1-15    9.  The board of dental examiners of Nevada.

1-16    10.  The state board of nursing.

1-17    11.  The state board of osteopathic medicine.

1-18    12.  The chiropractic physicians’ board of Nevada.

1-19    13.  The state board of Oriental medicine.

1-20    14.  The state board of podiatry.

1-21    15.  The Nevada state board of optometry.


2-1    16.  The board of dispensing opticians.

2-2    17.  The board of hearing aid specialists.

2-3    18.  The board of examiners for audiology and speech pathology.

2-4    19.  The Nevada state board of veterinary medical examiners.

2-5    20.  The state board of pharmacy.

2-21    34.  The Nevada state board of examiners for administrators of

2-22  facilities for long-term care.

2-23    35.  The certified court reporters’ board of Nevada.

2-24    Sec. 3.  1.  Each occupational licensing board shall, on or before

2-25  the 20th day of January, April, July and October, submit to the director

2-26  of the legislative counsel bureau a summary of each disciplinary action

2-27  taken during the immediately preceding calendar quarter against the

2-28  holder of a license, certificate, registration or permit issued by the

2-29  occupational licensing board.

2-30    2.  The director of the legislative counsel bureau shall:

2-31    (a) Provide any information he receives pursuant to subsection 1 to a

2-32  member of the public upon request;

2-33    (b) Cause a notice of the availability of such information to be posted

2-34  on the public website of the Nevada legislature on the Internet; and

2-35    (c) Transmit a compilation of the information he receives pursuant to

2-36  subsection 1 to the legislative commission quarterly, unless otherwise

2-37  directed by the commission.

2-38    Sec. 4.  1.  Each occupational licensing board shall, on or before

2-39  November 1 of each even-numbered year, submit a report of its activities

2-40  to the director of the legislative counsel bureau.

2-41    2.  The report must include, without limitation:

2-42    (a) The number of licenses, certificates, registrations and permits,

2-43  respectively, issued by the occupational licensing board during the

2-44  immediately preceding 2 fiscal years;

2-45    (b) A summary of the budget of the occupational licensing board

2-46  during the immediately preceding 2 fiscal years that is related to the

2-47  duties of the occupational licensing board pursuant to this Title,

2-48  including, without limitation, a description of all income and

2-49  expenditures related to such duties;


3-1    (c) A summary of each disciplinary action taken during the

3-2  immediately preceding 2 fiscal years against the holder of a license,

3-3  certificate, registration or permit issued by the occupational licensing

3-4  board; and

3-5    (d) Any other information that is requested by the director of the

3-6  legislative counsel bureau or which the occupational licensing board

3-7  determines would be helpful to the legislature in evaluating whether the

3-8  continued existence of the occupational licensing board is necessary.

3-9    3.  The director of the legislative counsel bureau shall compile all the

3-10  reports he receives and distribute copies of the compilation to the senate

3-11  standing committee on commerce and labor and the assembly standing

3-12  committee on commerce and labor, which each shall review the

3-13  compilation to determine whether the continued existence of each

3-14  occupational licensing board is necessary.
