AN ACT relating to state financial administration; authorizing the governor to set the date for the submittal of agency budgets; requiring the economic forum to make certain projections and estimates earlier; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 353.210 is hereby amended to read as follows:

1-2    353.210  1.  Except as otherwise provided in subsection 6, [on or

1-3  before August 15 of each even-numbered year,]the governor shall set a

1-4  date for each even numbered year by which all departments, institutions

1-5  and other agencies of the executive department of the state government,

1-6  and all agencies of the executive department of the state government

1-7  receiving state money, fees or other money under the authority of the state,

1-8  including those operating on money designated for specific purposes by the

1-9  constitution or otherwise, shall prepare, on blanks furnished them by the

1-10  chief, and submit to the chief estimates of their expenditure requirements,

1-11  together with all anticipated income from fees and all other sources, for the

1-12  next 2 fiscal years compared with the corresponding figures of the last

1-13  completed fiscal year and the estimated figures for the current fiscal year.

1-14    2.  The chief shall direct that one copy of the forms submitted pursuant

1-15  to subsection 1, accompanied by every supporting schedule and any other

1-16  related material, be delivered directly to the fiscal analysis division of the

1-17  legislative counsel bureau on or before [August 15 of each even-numbered

1-18  year.]the date set by the governor pursuant to subsection 1.


2-1    3.  The budget division of the department of administration shall give

2-2  advance notice to the fiscal analysis division of the legislative counsel

2-3  bureau of any conference between the budget division of the department of

2-4  administration and personnel of other state agencies regarding budget

2-5  estimates. A fiscal analyst of the legislative counsel bureau or his

2-6  designated representative may attend any such conference.

2-7    4.  The estimates of expenditure requirements submitted pursuant to

2-8  subsection 1 must be classified to set forth the data of funds, organizational

2-9  units, and the character and objects of expenditures, and must include a

2-10  mission statement and measurement indicators for each program. The

2-11  organizational units may be subclassified by functions and activities, or in

2-12  any other manner at the discretion of the chief.

2-13    5.  If any department, institution or other agency of the executive

2-14  department of the state government, whether its money is derived from

2-15  state money or from other money collected under the authority of the state,

2-16  fails or neglects to submit estimates of its expenditure requirements as

2-17  provided in this section, the chief may, from any data at hand in his office

2-18  or which he may examine or obtain elsewhere, make and enter a proposed

2-19  budget for the department, institution or agency in accordance with the

2-20  data.

2-21    6.  Agencies, bureaus, commissions and officers of the legislative

2-22  department, the public employees’ retirement system and the judicial

2-23  department of the state government shall submit to the chief for his

2-24  information in preparing the proposed executive budget the budgets which

2-25  they propose to submit to the legislature.

2-26    Sec. 2.  NRS 353.228 is hereby amended to read as follows:

2-27    353.228  1.  The economic forum impaneled pursuant to NRS 353.226

2-28  shall:

2-29    (a) Make such projections for economic indicators as it deems necessary

2-30  to ensure that an accurate estimate is produced pursuant to paragraph (b);

2-31    (b) Provide an accurate estimate of the revenue that will be collected by

2-32  the state for general, unrestricted uses, and not for special purposes, during

2-33  the biennium that begins on the second July 1 following the date on which

2-34  the economic forum was impaneled;

2-35    (c) Request such technical assistance as the economic forum deems

2-36  necessary from the technical advisory committee on future state revenues

2-37  created by NRS 353.229;

2-38    (d) On or before [December] November 1 of the year in which the

2-39  economic forum was impaneled, prepare a written report of its projections

2-40  of economic indicators and estimate of future state revenue required by

2-41  paragraphs (a) and (b) and present the report to the governor and the

2-42  legislature; and

2-43    (e) On or before May 1 of the year following the year in which the

2-44  economic forum was impaneled, prepare a written report confirming or

2-45  revising the projections of economic indicators and estimate of future state

2-46  revenue contained in the report prepared pursuant to paragraph (d) and

2-47  present the report to the governor and the legislature.

2-48    2.  The economic forum may make preliminary projections of

2-49  economic indicators and estimates of future state revenue at any time. Any


3-1  such projections and estimates must be made available to the various

3-2  agencies of the state through the chief.

3-3    3.  The economic forum may request information directly from any

3-4  state agency. A state agency that receives a reasonable request for

3-5  information from the economic forum shall comply with the request as

3-6  soon as is reasonably practicable after receiving the request.

3-7    4.  To carry out its duties pursuant to this section, the economic forum

3-8  may consider any information received from the technical advisory

3-9  committee and any other information received from independent sources.

3-10    5.  Copies of the projections and estimates made pursuant to this

3-11  section must be made available to the public by the director of the

3-12  legislative counsel bureau for the cost of reproducing the material.

 

3-13  H
