AN ACT relating to state financial administration; authorizing an institution or unit of the University and Community College System of Nevada to retain and carry forward for expenditure a certain portion of the unencumbered balance of an appropriation made from the state general fund for the support of the institution or unit; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 353.253 is hereby amended to read as follows:
1-2 353.253 1. Every agency, department and institution of the State of
1-3 Nevada shall deposit all money received from the Federal Government, the
1-4 counties or other sources, in the state treasury as provided in NRS 353.250
1-5 unless otherwise provided by law. These deposits must be made to work
1-6 program accounts directly or to other budget accounts.
1-7 2. Except for the balance in any proprietary fund and appropriated or
1-8 authorized reserves, and except as otherwise provided in this section, any
1-9 balance remaining at the end of a fiscal year in a budget account of an
1-10 agency, department or institution of the State of Nevada, whether or not
1-11 authorized for expenditure under a work program, reverts to the source of
1-12 funding supporting the agency, department or institution. If that source of
1-13 funding is federal money or a source of revenue the use of which is
1-14 restricted by statute, then the balance may be authorized for expenditure
1-15 under a work program for the subsequent fiscal year in accordance with the
1-16 provisions of this chapter.
2-1 3. Fifty percent of any balance of money appropriated from the state
2-2 general fund for the support of an institution or unit of the University
2-3 and Community College System of Nevada that is not committed for
2-4 expenditure at the end of a fiscal year may be retained by the institution
2-5 and carried forward for expenditure in any future fiscal year for the
2-6 purposes for which the money was appropriated.
2-7 4. No provision of this chapter may be construed to authorize or direct
2-8 the transfer, expenditure or reversion of any money received from the
2-9 Federal Government contrary to the conditions upon which that money was
2-10 received or to any federal law or regulation respecting the accountability
2-11 therefor.

2-14 apply to the board of regents of the University of Nevada and the Nevada
2-15 state museum.
2-16 Sec. 2. This act becomes effective on July 1, 2001.
