AN ACT relating to nuclear waste; creating the Nevada protection account in the state general fund; providing that the account be used to protect the State of Nevada and its residents through funding activities to prevent the location of a federal nuclear waste repository at Yucca Mountain; making an appropriation; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

   Section 1. Chapter 353 of NRS is hereby amended by adding thereto a

 new section to read as follows:

   1.  There is hereby created the Nevada protection account in the state

 general fund.

   2.  The money in the account must be used to protect the State of

 Nevada and its residents through funding activities to prevent the

 location of a federal nuclear waste repository at Yucca Mountain.

   3.  The account must be administered by the governor, who may:

   (a) Apply for and accept any gift, donation, bequest, grant or other

 source of money for deposit in the account; and

   (b) Expend any money received pursuant to paragraph (a) in

 accordance with subsection 2.

   4.  The interest and income earned on the money in the account, after

 deducting any applicable charges, must be credited to the account.

   5.  The money in the account must remain in the account and does

 not revert to the state general fund at the end of any fiscal year.

   Sec. 2.  There is hereby appropriated from the state general fund to the

 Nevada protection account created pursuant to section 1 of this act the sum

 of $4,000,000 to protect the State of Nevada and its residents through

 funding activities to prevent the location of a federal nuclear waste

 repository at Yucca Mountain.

   Sec. 3.  This act becomes effective upon passage and approval.
