AN ACT relating to nuclear waste; creating the Nevada protection account in the state general fund; providing that the account be used to protect the State of Nevada and its residents through funding activities to prevent the location of a federal nuclear waste repository at Yucca Mountain; making an appropriation; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 353 of NRS is hereby amended by adding thereto a
1-2 new section to read as follows:
1-3 1. There is hereby created the Nevada protection account in the state
1-4 general fund.
1-5 2. The money in the account must be used to protect the State of
1-6 Nevada and its residents through funding activities to prevent the
1-7 location of a federal nuclear waste repository at Yucca Mountain.
1-8 3. The account must be administered by the governor, who may:
1-9 (a) Apply for and accept any gift, donation, bequest, grant or other
1-10 source of money for deposit in the account; and
1-11 (b) Expend any money received pursuant to paragraph (a) in
1-12 accordance with subsection 2.
1-13 4. The interest and income earned on the money in the account, after
1-14 deducting any applicable charges, must be credited to the account.
1-15 5. The money in the account must remain in the account and does
1-16 not revert to the state general fund at the end of any fiscal year.
1-17 Sec. 2. There is hereby appropriated from the state general fund to the
1-18 Nevada protection account created pursuant to section 1 of this act the sum
1-19 of $4,000,000 to protect the State of Nevada and its residents through
2-1 funding activities to prevent the location of a federal nuclear waste
2-2 repository at Yucca Mountain.
2-3 Sec. 3. This act becomes effective upon passage and approval.
