AN ACT relating to homeopathic medicine; prohibiting a person from advertising himself as qualified to practice homeopathic medicine if he does not possess the requisite license or certificate; providing a penalty; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 630A.220 is hereby amended to read as follows:
1-2 630A.220 1. It is unlawful for any person:
1-3 (a) To practice homeopathic medicine;
1-4 (b) To hold himself out , or advertise himself, as qualified to practice
1-5 homeopathic medicine; or
1-6 (c) To use in connection with his name the words or letters “H.M.D.” or
1-7 any other title, word, letter or other designation intended to imply or
1-8 designate him as a practitioner of homeopathic medicine,
1-9 in this state without first obtaining a license so to do as provided in this
1-10 chapter.
1-11 2. A physician licensed pursuant to this chapter who holds a degree
1-12 such as doctor of medicine or doctor of osteopathy may identify himself by
1-13 that degree or its appropriate abbreviation, but unless he is also licensed
1-14 pursuant to chapter 630 or 633 of NRS must further identify himself by the
1-15 words “practitioner of homeopathic medicine” or their equivalent.
2-1 Sec. 2. NRS 630A.600 is hereby amended to read as follows:
2-2 630A.600 Except as otherwise provided in NRS 629.091, a person
2-3 who practices , or advertises himself as qualified to practice, homeopathic
2-4 medicine without a license or certificate issued pursuant to this chapter is
2-5 guilty of a category D felony and shall be punished as provided in NRS
2-6 193.130.
2-7 Sec. 3. This act becomes effective upon passage and approval.
