AN ACT relating to education; creating the fund for residency programs of the University of Nevada School of Medicine; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 396 of NRS is hereby amended by adding thereto a
1-2 new section to read as follows:
1-3 1. The fund for residency programs of the University of Nevada
1-4 School of Medicine is hereby created as a continuing fund without
1-5 reversion. The Dean of the University of Nevada School of Medicine
1-6 shall administer the fund. Any money received from:
1-7 (a) A direct legislative appropriation to the fund;
1-8 (b) A transfer from the state general fund of an amount equal to one-
1-9 quarter of the interest earned on money in the fund to stabilize the
1-10 operation of the state government made pursuant to NRS 353.288; and
1-11 (c) A grant, gift or donation to the fund,
1-12 must be deposited in the fund. The interest and income earned on the
1-13 money in the fund must, after deducting any applicable charges, be
1-14 credited to the fund.
1-15 2. Claims against the fund must be paid as other claims against the
1-16 state are paid.
1-17 3. The money in the fund may be used only for the development,
1-18 management and improvement of residency programs of the University
1-19 of Nevada School of Medicine which provide health care.
2-1 4. The University of Nevada School of Medicine may apply for any
2-2 available grants and accept any grants, gifts or donations for the support
2-3 of the residency programs.
2-4 Sec. 2. NRS 353.288 is hereby amended to read as follows:
2-5 353.288 1. The fund to stabilize the operation of the state
2-6 government is hereby created as a special revenue fund. Except as
2-7 otherwise provided in subsections 2 [and 3,] , 3 and 4, the state controller
2-8 shall deposit to the credit of the fund two-fifths of any revenue in the state
2-9 general fund collected by the state for general, unrestricted uses, and not
2-10 for special purposes, in excess of the amount necessary to:
2-11 (a) Pay all appropriations made for the support of the state government
2-12 for the fiscal year in which that revenue will be deposited in the fund; and
2-13 (b) Attain the reserve required by NRS 353.213.
2-14 2. The balance in the fund must not exceed 10 percent of the total of
2-15 all appropriations from the state general fund for the operation of all
2-16 departments, institutions and agencies of the state government and
2-17 authorized expenditures from the state general fund for the regulation of
2-18 gaming for the fiscal year in which that revenue will be deposited in the
2-19 fund.
2-20 3. Except as otherwise provided in this subsection and NRS 353.2735,
2-21 beginning with the fiscal year that begins on July 1, 1999, the state
2-22 controller shall, at the end of each quarter of a fiscal year, transfer from the
2-23 state general fund to the disaster relief fund created pursuant to NRS
2-24 353.2735 an amount equal to one-half of the interest earned on money in
2-25 the fund to stabilize the operation of the state government during the
2-26 previous quarter. The state controller shall not transfer more than $500,000
2-27 for any quarter pursuant to this subsection.
2-28 4. Beginning with the fiscal year that begins on July 1, 2003, the
2-29 state controller shall, at the end of each quarter of a fiscal year, transfer
2-30 from the state general fund to the fund for residency programs of the
2-31 University of Nevada School of Medicine created pursuant to section 1 of
2-32 this act an amount equal to one-quarter of the interest earned on money
2-33 in the fund to stabilize the operation of the state government during the
2-34 previous quarter.
2-35 5. Money from the fund to stabilize the operation of the state
2-36 government may be appropriated only:
2-37 (a) If the total actual revenue of the state falls short by 5 percent or
2-38 more of the total anticipated revenue for the biennium in which the
2-39 appropriation is made; or
2-40 (b) If the legislature and the governor declare that a fiscal emergency
2-41 exists.
2-42 Sec. 3. This act becomes effective on July 1, 2001.
2-43 H
