AN ACT relating to peace officers; authorizing a peace officer to detain a witness to a crime under certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 171 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  Any peace officer may detain any person whenever:

1-4    (a) The officer has reasonable cause to believe that a crime involving

1-5  forcible bodily injury has just been committed near the place where the

1-6  officer finds the person;

1-7    (b) The officer has reasonable cause to believe that the person has

1-8  knowledge of material aid in the investigation of the crime; and

1-9    (c) Such detention is reasonably necessary to obtain or verify the

1-10  identification of the person or to obtain an account of the crime.

1-11    2.  A person must not be detained longer than is reasonably necessary

1-12  to effect the purposes of this section, and in no event longer than 60

1-13  minutes. The detention must not extend beyond the place or the

1-14  immediate vicinity of the place where the detention was first effected.

1-15    Sec. 2.  This act becomes effective upon passage and approval.
