AN ACT relating to the department of motor vehicles and public safety; revising the amount of money required to be transferred annually from the account for verification of insurance to the state highway fund; requiring the department to increase certain fees as necessary to cover the actual cost of production of photographs for drivers’ licenses and identification cards; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 482.4805 is hereby amended to read as follows:
1-2 482.4805 On June 30 of each year the state controller shall transfer
1-3 from the account for verification of insurance created pursuant to NRS
1-4 482.480 to the state highway fund any amount in the account which
1-5 exceeds [$1,000,000.] $500,000.
1-6 Sec. 2. NRS 483.347 is hereby amended to read as follows:
1-7 483.347 1. Except as otherwise provided in subsection 2, the
1-8 department shall issue a driver’s license which bears a front view colored
1-9 photograph of the licensee if he is 21 years of age or older, or a profile
1-10 view colored photograph if he is under 21 years of age.
1-11 2. The department may issue a temporary driver’s license without a
1-12 photograph of the licensee if the licensee is temporarily absent from this
1-13 state and requests the renewal of, the issuance of a duplicate of, or a change
1-14 in the information on, his driver’s license. If the licensee returns to this
1-15 state for 14 continuous days or more, the licensee shall, within 24 days
1-16 after the date of his return, surrender the temporary license and obtain a
1-17 license which bears his photograph in accordance with subsection 1. A
1-18 licensee charged with violating the provisions of this subsection may not
1-19 be convicted if he surrenders the temporary license, obtains a license which
2-1 bears his photograph in accordance with subsection 1 and produces that
2-2 license in court or in the office of the arresting officer.
2-3 3. The department shall:
2-4 (a) Establish a uniform procedure for the production of drivers’
2-5 licenses, applicable to renewal as well as to original licenses.
2-6 (b) [Increase] By regulation, increase the fees provided in NRS
2-7 483.410, 483.820 and 483.910 [by an amount up to $1.] as necessary to
2-8 cover the actual cost of production of photographs for drivers’ licenses
2-9 and identification cards. The increase must be deposited in the state
2-10 treasury for credit to the motor vehicle fund and must be allocated to the
2-11 department to defray the increased costs of producing drivers’ licenses
2-12 required by this section.
2-13 Sec. 3. NRS 483.820 is hereby amended to read as follows:
2-14 483.820 1. A person who applies for an identification card in
2-15 accordance with the provisions of NRS 483.810 to 483.890, inclusive, is
2-16 entitled to receive an identification card if he is:
2-17 (a) A resident of this state and is 10 years of age or older and does not
2-18 hold a valid driver’s license or identification card from any state or
2-19 jurisdiction; or
2-20 (b) A seasonal resident who does not hold a valid Nevada driver’s
2-21 license.
2-22 2. The department shall charge and collect the following fees for the
2-23 issuance of an original, duplicate or changed identification card:
2-24 An original or duplicate identification card issued to a person 65
2-25 years of age or older....... $4
2-26 An original or duplicate identification card issued to a person under
2-27 18 years of age................. 3
2-28 An original or duplicate identification card issued to any other
2-29 person............................. 9
2-30 A new photograph or change of name, or both..................... 4
2-31 3. The department shall not charge a fee for an identification card
2-32 issued to a person who has voluntarily surrendered his driver’s license
2-33 pursuant to NRS 483.420.
2-34 4. The increase in fees authorized in NRS 483.347 must be paid in
2-35 addition to the fees charged pursuant to this section.
2-36 5. As used in this section, “photograph” has the meaning ascribed to it
2-37 in NRS 483.125.
2-38 Sec. 4. This act becomes effective on July 1, 2001.
