AN ACT relating to the state executive department; creating the Nevada commission on
children and families; establishing its powers and duties; requiring the
director of the department of human resources to provide certain staff
assistance to the commission; and providing other matters properly relating
thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Title 18 of
NRS is hereby amended by adding thereto a
1-2 new chapter to consist of
the provisions set forth as sections 2 to 9,
1-3 inclusive, of this act.
1-4 Sec. 2. As used in this
chapter, unless the context otherwise
1-5 requires, “commission” means the Nevada commission on children and
1-6 families.
1-7 Sec. 3. 1. The Nevada commission on children and
families,
1-8 consisting of 12 members appointed by the governor, is hereby
created.
1-9 2. The governor shall designate one member of
the commission to
1-10 serve as chairman and one member of the commission to serve as vice
1-11 chairman.
1-12 3. Each chairman, vice chairman and other
officer of the
1-13 commission shall serve for a term of 4 years.
1-14 4. No more than six members of the commission
may be from the
1-15 same political party.
1-16 Sec. 4. 1. Except for the initial members, the term of
office of each
1-17 member of the commission is 4 years and commences on July 1 of the
1-18 year of appointment. The members shall continue in office until
their
1-19 successors are appointed. Members are eligible for reappointment,
except
1-20 that no member may serve for any part of more than two consecutive
2-1 terms. Vacancies must be filled by appointment for the unexpired
terms
2-2 by the governor.
2-3 2. Members of the
commission serve without compensation, but are
2-4 entitled to be reimbursed for all travel and other expenses
actually and
2-5 necessarily incurred in the performance of their duties, within the
limits
2-6 of available money.
2-7 Sec. 5. 1. The commission shall meet at the call of the
chairman as
2-8 frequently as required to perform its duties, but not less than
quarterly. A
2-9 majority of the members of the commission constitutes a quorum for
the
2-10 transaction of business, and a majority of a quorum present at any
2-11 meeting is sufficient for any official action taken by the
commission.
2-12 2. The chairman of the commission may, with the
approval of the
2-13 commission, appoint committees from among its members to assist in
2-14 carrying out the functions or duties of the commission.
2-15 Sec. 6. The commission shall:
2-16 1. In cooperation with interested state and
local public and private
2-17 entities:
2-18 (a) Promote community
efforts and responsibility for the well-being of
2-19 children and families in this state.
2-20 (b) Establish policies for
the provision of services to children and
2-21 families in this state that assist in the development of a stable,
safe and
2-22 healthful environment for those children and families.
2-23 2. Identify, foster and evaluate programs,
services and resources for
2-24 children and families in this state.
2-25 3. Identify inefficiencies, duplications and
deficiencies in programs,
2-26 services and resources for children and families in this state.
2-27 4. Identify and monitor the availability and use
of federal, state and
2-28 local public and private funding for programs, services and
resources for
2-29 children and families in this state.
2-30 5. Identify and evaluate the provisions of the
state budget that affect
2-31 programs, services and resources for children and families in this
state.
2-32 6. On or before November 1 of each year, submit
a report to the
2-33 governor and the legislative commission summarizing the activities,
2-34 needs and recommendations of the commission.
2-35 Sec. 7. 1. The commission shall appoint an executive
director who
2-36 is in the unclassified service of the state and serves at the
pleasure of the
2-37 commission. The executive director is entitled to an annual salary
as
2-38 fixed by the commission within the limits of available money.
2-39 2. The executive director shall administer the
provisions of this
2-40 chapter under the direction and supervision of the commission.
2-41 Sec. 8. 1. The director of the department of human
resources shall
2-42 provide such staff and assistance to the commission as the governor
2-43 deems appropriate.
2-44 2. The commission may engage the services of
such volunteer
2-45 workers and consultants without salary as it deems necessary.
2-46 Sec. 9. The commission may
apply for and receive gifts, grants,
2-47 contributions or other money from the Federal Government, private
2-48 agencies, affiliated associations and other persons for the
purposes of
3-1 carrying out the provisions of this chapter and for defraying
expenses
3-2 incurred by the commission in the discharge of its duties.
3-3 Sec. 10. As soon as practicable after July 1, 2001, the governor shall
3-4 appoint to the Nevada
commission on children and families:
3-5 1. Three members whose
terms expire on June 30, 2002.
3-6 2. Three members whose
terms expire on June 30, 2003.
3-7 3. Three members whose
terms expire on June 30, 2004.
3-8 4. Three members whose
terms expire on June 30, 2005.
3-9 Sec. 11. This act becomes effective on July 1, 2001.
