AN ACT relating to education; requiring the state board of education to prescribe a form
for use by public schools to provide reports to parents and legal guardians
regarding the involvement of the parents and legal guardians in the education
of their children; requiring the use of the form in public schools; and
providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 392
of NRS is hereby amended by adding thereto a
1-2 new section to read as
follows:
1-3 1. The state board shall prescribe a form for
use by public schools to
1-4 provide reports to parents and legal guardians of pupils regarding
the
1-5 involvement of the parents and legal guardians in the education of
their
1-6 children. The state board shall work in consultation with the
department,
1-7 the legislative bureau of educational accountability and program
1-8 evaluation, the Nevada Association of School Boards, the Nevada
State
1-9 Education Association and the Nevada Parent Teacher Association in
1-10 the development of the form. The form must include, without
limitation:
1-11 (a) A report of whether the
parent or legal guardian ensures the
1-12 attendance and punctuality of the pupil, including, without
limitation,
1-13 whether the pupil:
1-14 (1) Completes his homework
assignments in a timely manner;
1-15 (2) Is present in the
classroom when school begins each day unless
1-16 his absence is approved in accordance with NRS 392.130; and
1-17 (3) Is present in the
classroom for the entire school day unless his
1-18 absence is approved in accordance with NRS 392.130;
2-1 (b) A report of whether the
parent or legal guardian ensures the
2-2 health and safety of the pupil, including, without limitation,
whether:
2-3 (1) Current information
is on file with the school that designates
2-4 each person whom the school should contact if an emergency
involving
2-5 the pupil occurs;
2-6 (2) Current information
is on file with the school regarding the
2-7 health of the pupil, such as immunization records, if applicable,
and any
2-8 special medical needs of the pupil;
2-9 (3) The parent and child
abide by any applicable rules and policies
2-10 of the school and the school district; and
2-11 (4) The pupil is dressed
appropriately for public school; and
2-12 (c) A report of the
participation of the parent or legal guardian,
2-13 including, without limitation, whether the parent or legal
guardian:
2-14 (1) Completes forms and
other documents that are required by the
2-15 school or school district in a timely manner;
2-16 (2) Assists in carrying out
a plan to improve the pupil’s academic
2-17 achievement, if applicable;
2-18 (3) Attends conferences
between the teacher and the parent or legal
2-19 guardian, if applicable; and
2-20 (4) Attends school
activities.
2-21 The board of trustees of a school district or the governing body of
a
2-22 charter school may prescribe an expanded form that contains
additions
2-23 to the form prescribed by the state board if the expanded form is
set forth
2-24 in an identical format as the form prescribed by the state board
and
2-25 contains the information set forth in paragraphs (a), (b) and (c).
2-26 2. Neither the form prescribed by the state
board nor an expanded
2-27 form prescribed by the board of trustees of a school district or
the
2-28 governing body of a charter school may be used in a manner that:
2-29 (a) Interferes unreasonably
with the personal privacy of the parent
2-30 and his child or the legal guardian and his ward; or
2-31 (b) Reprimands a parent or
legal guardian.
2-32 3. If a public school, including, without
limitation, a charter school,
2-33 receives money from this state to provide remediation to pupils who
are
2-34 enrolled in the public school based upon the performance of the
pupils
2-35 on the achievement and proficiency examinations administered
pursuant
2-36 to NRS 389.015, the public school shall use the form prescribed by
the
2-37 state board or an expanded form, if applicable.
2-38 4. In addition to the public schools that are
required to use the form
2-39 pursuant to subsection 3, the:
2-40 (a) Board of trustees of a
school district may require all public schools
2-41 within the school district to use the form prescribed by the state
board or
2-42 an expanded form, if applicable, prescribed by the board of
trustees.
2-43 (b) Governing body of a
charter school may require the charter school
2-44 to use the form prescribed by the state board or an expanded form,
if
2-45 applicable, prescribed by the governing body.
2-46 5. Except as otherwise provided in this
subsection, if a public school
2-47 is required to use a form pursuant to subsection 3 or 4, one form
must be
2-48 completed for each household of a pupil who is enrolled in the
school. If
2-49 the parents of a pupil do not reside in the same household, the
principal
3-1 or the administrative head of the public school in which the pupil
is
3-2 enrolled shall determine whether one form must be completed or whether
3-3 a form for each parent must be completed. If a pupil has more than
one
3-4 teacher who provides classroom instruction to the pupil, the
principal or
3-5 administrative head of the public school shall designate one of the
3-6 pupil’s teachers to complete the form. The teacher who is
designated by
3-7 the principal or administrative head shall consult with the other
teachers
3-8 who provide classroom instruction to the pupil to ensure that the
teacher
3-9 has all the information necessary to complete the form.
3-10 6. A form must be completed twice each school
year when the
3-11 teacher prepares a report card or other report of progress for the
pupil. A
3-12 form that is completed by a teacher must be delivered to the parent
or
3-13 legal guardian in the same manner that the report card or other
report of
3-14 progress is delivered to the parent or legal guardian.
3-15 7. The principal or administrative head of each
public school that is
3-16 required to use a form pursuant to subsection 3 or 4 shall provide
each
3-17 teacher who is required to complete a form with all the information
3-18 necessary to ensure completion of the form if the teacher does not
have
3-19 such information in his possession.
3-20 8. The state board shall make the basic form
available on computer
3-21 disk for use by school districts and charter schools and, upon
request, in
3-22 any other manner deemed reasonable by the state board.
3-23 Sec. 2. The state board of education shall prescribe a form in
3-24 accordance with section 1 of
this act on or before September 1, 2001, for
3-25 use by school districts and
charter schools commencing with the 2001-
3-26 2002 school year.
3-27 Sec. 3. This act becomes effective upon passage and approval.
