AN ACT relating to correctional officers; requiring correctional
officers employed by the department of prisons to complete a program for
facility training; and providing other matters
properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 209
of NRS is hereby amended by adding thereto a
1-2 new section to read as
follows:
1-3 1. Except as otherwise provided in subsection 4,
the department shall
1-4 require each correctional officer hired by the department to
complete a
1-5 program for facility training not later than 1 year after he begins
his
1-6 employment with the department.
1-7 2. The program for facility training must
consist of five phases that
1-8 include:
1-9 (a) At least 40 hours of
instruction in facility orientation, including,
1-10 without limitation, the structure, organization and operation of
the
1-11 facility or institution where the correctional officer is employed.
1-12 (b) At least 80 hours of
instruction in search and escort, including,
1-13 without limitation, the pursuit and return of offenders who have
escaped,
1-14 transportation and escort of offenders, and exercise of control over
1-15 offenders inside and outside the facilities and institutions of the
1-16 department.
1-17 (c) At least 80 hours of
instruction in general population housing,
1-18 including, without limitation, maintaining order, discipline and
security
1-19 within the housing units of the general population of the facility
or
1-20 institution.
2-1 (d) At least 80 hours of
instruction in special population housing,
2-2 including, without limitation, disciplinary segregation, protective
2-3 segregation and administrative segregation of the general
population of
2-4 the facility or institution.
2-5 (e) After the correctional
officer has completed successfully the first
2-6 four phases of the program set forth in paragraphs (a) to (d),
inclusive, at
2-7 least 40 hours of quasi-solo activities to determine his knowledge
of the
2-8 facility or institution where he is employed and his proficiency in
2-9 performing the duties for which he received instruction.
2-10 3. The director shall:
2-11 (a) Institute the program
for facility training in all facilities and
2-12 institutions of the department; and
2-13 (b) With the approval of the
board, adopt regulations to carry out the
2-14 provisions of this section.
2-15 4. The director may, within his discretion,
waive the requirement that
2-16 a correctional officer complete the program for facility training
pursuant
2-17 to this section if the director determines that the correctional
officer has
2-18 previously completed a comparable program of training.
2-19 5. As used in this section, “correctional
officer” means any
2-20 correctional officer designated as having the powers of a peace
officer
2-21 pursuant to subsection 1 of NRS 289.220.
2-22 Sec. 2. 1. Except as otherwise
provided in subsection 2, a
2-23 correctional officer who is
employed by the department of prisons on
2-24 October 1, 2001, shall
complete the program for facility training required
2-25 by section 1 of this act
before October 1, 2002.
2-26 2. The director may, within
his discretion, waive the requirement that a
2-27 correctional officer
complete the program for facility training if the director
2-28 determines that the
correctional officer has previously completed a
2-29 comparable program of
training.
2-30 H
