AN ACT relating to motor vehicles; providing for the issuance of special license plates for the support of the reconstruction, maintenance, improvement and promotion of the Virginia & Truckee Railroad; providing for the issuance of souvenir license plates that indicate support for the reconstruction, maintenance, improvement and promotion of the Virginia & Truckee Railroad; imposing a fee for the issuance or renewal of special license plates to finance the reconstruction, maintenance, improvement and promotion of the Virginia & Truckee Railroad; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1.  Chapter 482 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  Except as otherwise provided in this subsection, the department, in

1-4  cooperation with the Northern Nevada Railway Foundation or its

1-5  successor, shall design, prepare and issue license plates for the support

1-6  of the reconstruction, maintenance, improvement and promotion of the

1-7  Virginia & Truckee Railroad using any colors that the department deems

1-8  appropriate. The design of the license plates must include a depiction of

1-9  a locomotive of the Virginia & Truckee Railroad and the phrase “The

1-10  Virginia & Truckee Lives.” The department shall not design, prepare or

1-11  issue the license plates unless it receives at least 250 applications for the

1-12  issuance of those plates.

 


2-1    2.  If the department receives at least 250 applications for the

2-2  issuance of license plates for the support of the reconstruction,

2-3  maintenance, improvement and promotion of the Virginia & Truckee

2-4  Railroad, the department shall issue those plates for a passenger car or

2-5  light commercial vehicle upon application by a person who is entitled to

2-6  license plates pursuant to NRS 482.265 and who otherwise complies with

2-7  the requirements for registration and licensing pursuant to this chapter.

2-8  A person may request that personalized prestige license plates issued

2-9  pursuant to NRS 482.3667 be combined with license plates for the

2-10  support of the reconstruction, maintenance, improvement and promotion

2-11  of the Virginia & Truckee Railroad if that person pays the fees for the

2-12  personalized prestige license plates in addition to the fees for the license

2-13  plates for the support of the reconstruction, maintenance, improvement

2-14  and promotion of the Virginia & Truckee Railroad pursuant to

2-15  subsections 3 and 4.

2-16    3.  The fee for license plates for the support of the reconstruction,

2-17  maintenance, improvement and promotion of the Virginia & Truckee

2-18  Railroad is $35, in addition to all other applicable registration and

2-19  license fees and governmental services taxes. The license plates are

2-20  renewable upon the payment of $10.

2-21    4.  In addition to all other applicable registration and license fees and

2-22  governmental services taxes and the fee prescribed in subsection 3, a

2-23  person who requests a set of license plates for the support of the

2-24  reconstruction, maintenance, improvement and promotion of the

2-25  Virginia & Truckee Railroad must pay for the initial issuance of the

2-26  plates an additional fee of $25 and for each renewal of the plates an

2-27  additional fee of $20, to be distributed pursuant to subsection 5.

2-28    5.  The department shall transmit the fees collected pursuant to

2-29  subsection 4 to the treasurer with whom the Tricounty Railway

2-30  Commission of Carson City and Lyon and Storey counties has entered

2-31  into an agreement as required by subsection 2 of section 8 of chapter

2-32  566, Statutes of Nevada 1993, for deposit in the fund created pursuant to

2-33  that section. The fees transmitted pursuant to this subsection must be

2-34  used only for the reconstruction, maintenance, improvement and

2-35  promotion of the Virginia & Truckee Railroad.

2-36    6.  If, during a registration year, the holder of license plates issued

2-37  pursuant to the provisions of subsections 1 to 6, inclusive, disposes of the

2-38  vehicle to which the plates are affixed, the holder shall:

2-39    (a) Retain the plates and affix them to another vehicle that meets the

2-40  requirements of subsections 1 to 6, inclusive, if the transfer and

2-41  registration fees are paid as set out in this chapter; or

2-42    (b) Within 30 days after removing the plates from the vehicle, return

2-43  them to the department.

2-44    7.  Except as otherwise provided in this subsection, the director shall,

2-45  at the request of the Northern Nevada Railway Foundation or its

2-46  successor:

2-47    (a) Order the design and preparation of souvenir license plates that

2-48  indicate support for the reconstruction, maintenance, improvement and

2-49  promotion of the Virginia & Truckee Railroad; and


3-1    (b) Issue such souvenir license plates only to the Northern Nevada

3-2  Railway Foundation or its successor for a fee established pursuant to

3-3  NRS 482.3825. The Northern Nevada Railway Foundation or its

3-4  successor may resell such souvenir license plates at a price determined by

3-5  the Foundation or its successor.

3-6  The director shall not order the design or preparation of souvenir license

3-7  plates pursuant to this subsection unless the department has received at

3-8  least 250 applications for the issuance of license plates for the support of

3-9  the reconstruction, maintenance, improvement and promotion of the

3-10  Virginia & Truckee Railroad pursuant to subsections 1 to 6, inclusive.

3-11    Sec. 2.  NRS 482.216 is hereby amended to read as follows:

3-12    482.216  1.  Upon the request of a new vehicle dealer, the department

3-13  may authorize the new vehicle dealer to:

3-14    (a) Accept applications for the registration of the new motor vehicles he

3-15  sells and the related fees and taxes;

3-16    (b) Issue certificates of registration to applicants who satisfy the

3-17  requirements of this chapter; and

3-18    (c) Accept applications for the transfer of registration pursuant to NRS

3-19  482.399 if the applicant purchased from the new vehicle dealer a new

3-20  vehicle to which the registration is to be transferred.

3-21    2.  A new vehicle dealer who is authorized to issue certificates of

3-22  registration pursuant to subsection 1 shall:

3-23    (a) Transmit the applications he receives to the department within the

3-24  period prescribed by the department;

3-25    (b) Transmit the fees he collects from the applicants and properly

3-26  account for them within the period prescribed by the department;

3-27    (c) Comply with the regulations adopted pursuant to subsection 4; and

3-28    (d) Bear any cost of equipment which is necessary to issue certificates

3-29  of registration, including any computer hardware or software.

3-30    3.  A new vehicle dealer who is authorized to issue certificates of

3-31  registration pursuant to subsection 1 shall not:

3-32    (a) Charge any additional fee for the performance of those services;

3-33    (b) Receive compensation from the department for the performance of

3-34  those services;

3-35    (c) Accept applications for the renewal of registration of a motor

3-36  vehicle; or

3-37    (d) Accept an application for the registration of a motor vehicle if the

3-38  applicant wishes to:

3-39      (1) Obtain special license plates pursuant to NRS 482.3667 to

3-40  482.3825, inclusive[;] , and section 1 of this act; or

3-41      (2) Claim the exemption from the governmental services tax provided

3-42  pursuant to NRS 361.1565 to veterans and their relations.

3-43    4.  The director shall adopt such regulations as are necessary to carry

3-44  out the provisions of this section. The regulations adopted pursuant to this

3-45  subsection must provide for:

3-46    (a) The expedient and secure issuance of license plates and decals by

3-47  the department; and


4-1    (b) The withdrawal of the authority granted to a new vehicle dealer

4-2  pursuant to subsection 1 if that dealer fails to comply with the regulations

4-3  adopted by the department.

4-4    Sec. 3.  NRS 482.3825 is hereby amended to read as follows:

4-5    482.3825  1.  The director may order the design and preparation of

4-6  souvenir license plates which are easily distinguishable in design or color

4-7  from regular license plates. Thedirector may establish a fee for the

4-8  issuance of such plates of not more than $15 per plate. The department may

4-9  issue more than one plate of any particular design.

4-10    2.  Allmoney collected from the issuance of souvenir license plates

4-11  must be deposited in the state treasury for credit to the motor vehicle fund.

4-12    3.  As used in this section, “issuance” does not include the resale of a

4-13  souvenir license plate.

4-14    Sec. 4.  NRS 482.500 is hereby amended to read as follows:

4-15    482.500  1.  Except as otherwise provided in subsection 2 or 3,

4-16  whenever upon application any duplicate or substitute certificate of

4-17  registration, decal or number plate is issued, the following fees must be

4-18  paid:

4-19    For a certificate of registration.................. $5.00

4-20    For every substitute number plate or set of plates   5.00

4-21    For every duplicate number plate or set of plates   10.00

4-22    For every decal displaying a county name...   .50

4-23    For every other decal, license plate sticker or tab   5.00

4-24    2.  The following fees must be paid for any replacement plate or set of

4-25  plates issued for the following special license plates:

4-26    (a) For any special plate issued pursuant to NRS 482.3667, 482.3672,

4-27  482.3675, 482.370 to 482.376, inclusive, or 482.379 to 482.3816,

4-28  inclusive, and section 1 of this act, a fee of $10.

4-29    (b) For any special plate issued pursuant to NRS 482.368, 482.3765,

4-30  482.377 or 482.378, a fee of $5.

4-31    (c) [For] Except as otherwise provided in section 1 of this act, for any

4-32  souvenir license plate issued pursuant to NRS 482.3825 or sample license

4-33  plate issued pursuant to NRS 482.2703, a fee equal to that established by

4-34  the director for the issuance of those plates.

4-35    3.  A fee must not be charged for a duplicate or substitute of a decal

4-36  [requested] issued pursuant to NRS 482.37635.

4-37    4.  The fees which are paid for duplicate number plates and decals

4-38  displaying county names must be deposited with the state treasurer for

4-39  credit to the motor vehicle fund and allocated to the department to defray

4-40  the costs of duplicating the plates and manufacturing the decals.

4-41    5.  As used in this section:

4-42    (a) “Duplicate number plate” means a license plate or a set of license

4-43  plates issued to a registered owner which repeat the code of a plate or set of

4-44  plates previously issued to the owner to maintain his registration using the

4-45  same code.

4-46    (b) “Substitute number plate” means a license plate or a set of license

4-47  plates issued in place of a previously issued and unexpired plate or set of

4-48  plates. The plate or set of plates does not repeat the code of the previously

4-49  issued plate or set.


5-1  Sec. 5.  Section 8 of chapter 566, Statutes of Nevada 1993, at page

5-2  2329, is hereby amended to read as follows:

              5-3  Sec. 8. 1.  The commission may enter into an agreement with

              5-4  the district attorney of Carson City or Douglas, Lyon, Storey or

              5-5  Washoe County, or any combination thereof, to provide legal services

              5-6  to the commission. The commission may authorize payment to the

              5-7  district attorney for the costs to the district attorney for providing

              5-8  those services.

              5-9  2.  The commission shall enter into an agreement with the

              5-10  treasurer of Carson City or Douglas, Lyon, Storey or Washoe County

              5-11  to create a fund for the commission and pay all claims against the

              5-12  fund that are properly approved by the commission. The commission

              5-13  may authorize payment to the treasurer for the costs to the treasurer

              5-14  for providing those services.

              5-15  3.  All money received by the commission must be deposited in

              5-16  the fund created pursuant to subsection 2. [The] Except as otherwise

              5-17  provided in section 1 of Senate Bill No. 77 of the 2001 legislative

              5-18  session, the money in the fund must be used only for the necessary

              5-19  expenses of the commission and the costs of the projects authorized

              5-20  by this act.

5-21    Sec. 6.  On or before October 1, 2005, the department of motor

5-22  vehicles and public safety shall determine and publicly declare the number

5-23  of applications it has received for the issuance of a license plate pursuant to

5-24  subsections 1 to 6, inclusive, of section 1 of this act.

5-25    Sec. 7.  The amendatory provisions of this act expire by limitation on

5-26  October 1, 2005, if on that date the department of motor vehicles and

5-27  public safety has received fewer than 250 applications for the issuance of a

5-28  license plate pursuant to subsections 1 to 6, inclusive, of section 1 of this

5-29  act.
