AN ACT relating to long-term care; directing the Legislative Commission to appoint a subcommittee to continue the study of long-term care in this state; authorizing the subcommittee to appoint an advisory committee; requiring the subcommittee to employ a consultant; making an appropriation; and providing other matters properly relating thereto.

 

   Whereas, The Legislative Commission was directed by Senate Concurrent Resolution No. 4 of the 70th session of the Nevada Legislature to appoint a subcommittee to conduct an interim study concerning long-term care in this state; and

   Whereas, The study was conducted during the 1999-2000 legislative interim and it facilitated discussions among the members of the subcommittee and national, state and local experts concerning a multitude of issues relating to long-term care in this state; and

   Whereas, Because of the number and complexity of issues addressed by the subcommittee, the subcommittee concluded that a second phase of discussion, oversight and consideration of those issues was necessary to ensure significant improvements in long-term care in this state; now, therefore,

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 


2-1    Section 1.  1.  The Legislative Commission shall appoint a

2-2  subcommittee, consisting of three members of the Senate and three

2-3  members of the Assembly, to continue the study of long-term care in this

2-4  state.

2-5    2.  The members of the subcommittee:

2-6    (a) Shall employ a consultant who has special expertise in the areas of

2-7  the study to assist the subcommittee in carrying out its duties; and

2-8    (b) May appoint an advisory committee, consisting of persons who are

2-9  knowledgeable in the areas of the study, to consult with and to assist the

2-10  subcommittee in carrying out its duties.

2-11    3.  If the subcommittee appoints an advisory committee pursuant to

2-12  subsection 2:

2-13    (a) The chairman of the subcommittee shall designate one member of

2-14  the advisory committee to serve as chairman of the advisory committee;

2-15  and

2-16    (b) The members of the advisory committee serve without

2-17  compensation and are not entitled to receive a per diem allowance or travel

2-18  expenses.

2-19    4.  The study must include, without limitation:

2-20    (a) A review and evaluation of the statutes and regulations in this state

2-21  relating to long-term care and a determination of whether and, if necessary,

2-22  the manner in which those statutes and regulations should be amended to

2-23  incorporate and define the types of services related to long-term care that

2-24  are available in this state, including, without limitation, a facility for

2-25  assisted living;

2-26    (b) The development of standards governing the provision of

2-27  nonmedical services related to long-term care and whether those services

2-28  are provided in a facility for long-term care or as part of home health care,

2-29  including, without limitation, standards governing:

2-30      (1) The procedures used to evaluate and monitor the quality of those

2-31  services; and

2-32      (2) The amount of training that a person who provides those services

2-33  is required to complete;

2-34    (c) An evaluation of a system of long-term care that integrates the

2-35  services related to long-term care that are provided in other states to allow

2-36  a person to access those services from a single point in the system and a

2-37  determination of the feasibility of using such a system in this state;

2-38    (d) The monitoring of the recommendations made by the subcommittee

2-39  appointed pursuant to Senate Concurrent Resolution No. 4 of the 70th

2-40  session of the Nevada Legislature, and any legislation recommended by

2-41  that subcommittee and enacted by the 71st session of the Nevada

2-42  Legislature; and

2-43    (e) An evaluation of the feasibility of obtaining a waiver from the

2-44  Federal Government to integrate and coordinate services related to acute

2-45  care that are covered by Medicare and services related to long-term care

2-46  that are covered by Medicaid in this state.


3-1    5.  Any recommended legislation proposed by the subcommittee must

3-2  be approved by a majority of the members of the Senate and a majority of

3-3  the members of the Assembly appointed to the subcommittee.

3-4    6.  The Legislative Commission shall submit a report of the results of

3-5  the study and any recommendations for legislation to the 72nd session of

3-6  the Nevada Legislature.

3-7    Sec. 2.  1.  There is hereby appropriated from the state general fund

3-8  to the subcommittee appointed pursuant to section 1 of this act the sum of

3-9  $26,900 for the services and cost of travel of the consultant employed by

3-10  the subcommittee pursuant to section 1 of this act.

3-11    2.  Any remaining balance of the appropriation made pursuant to

3-12  subsection 1 must not be committed for expenditure after June 30, 2002,

3-13  and reverts to the state general fund as soon as all payments of money

3-14  committed have been made.

3-15    Sec. 3.  This act becomes effective upon passage and approval.
