AN ACT relating to the Nevada highway patrol; requiring the director of the department of
personnel to calculate the average salaries of certain law enforcement
personnel; requiring the proposed budget of the department of motor vehicles
and public safety to include salaries for officers of the Nevada highway patrol
which are based on those calculations; and providing other matters properly
relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 284
of NRS is hereby amended by adding thereto a
1-2 new section to read as
follows:
1-3 1. The director shall calculate the respective
average salaries as of
1-4 July 1 of each even-numbered year of all police officers of
equivalent
1-5 rank employed by:
1-6 (a) Law enforcement agencies
of cities whose populations are 50,000
1-7 or more;
1-8 (b) Law enforcement agencies
of counties whose populations are
1-9 100,000 or more; and
1-10 (c) Metropolitan police
departments formed pursuant to chapter 280
1-11 of NRS in counties whose populations are 100,000 or more.
1-12 2. The director shall forward the figures of the
average salaries
1-13 calculated pursuant to subsection 1 to the chief of the budget
division of
1-14 the department of administration and the director of the department
of
1-15 motor vehicles and public safety not later than July 15 of each
even-
1-16 numbered year.
1-17 Sec. 2. Chapter 353 of NRS is hereby amended by adding thereto a
1-18 new section to read as
follows:
2-1 1. In preparing the proposed biennial budget of
the department of
2-2 motor vehicles and public safety, the director of the department
shall
2-3 establish the respective salaries of the officers of the Nevada
highway
2-4 patrol at amounts which:
2-5 (a) For the first year of
the biennium, are equal to or greater than the
2-6 average salary of police officers of equivalent rank as calculated
by the
2-7 director of the department of personnel pursuant to section 1 of
this act;
2-8 and
2-9 (b) For the second year of
the biennium, are equal to the respective
2-10 amounts proposed pursuant to paragraph (a), plus an adjustment for
2-11 inflation, if any. The amount of the adjustments must be determined
by
2-12 multiplying the respective amounts proposed pursuant to paragraph
(a)
2-13 by the percentage of inflation, if any. The Consumer Price Index
2-14 published by the United States Department of Labor for July
preceding
2-15 each biennium must be used to determine the percentage of
inflation.
2-16 2. In preparing the proposed executive budget,
the chief shall ensure
2-17 that the salaries of the officers of the Nevada highway patrol, as
included
2-18 in the proposed budget of the department of motor vehicles and
public
2-19 safety, are established in accordance with the provisions of
subsection 1.
2-20 Sec. 3. NRS 353.150 is hereby amended to read as follows:
2-21 353.150 NRS 353.150 to
353.246, inclusive, and section 2
of this act,
2-22 may be cited as the State
Budget Act.
2-23 Sec. 4. Not later than 10 days after the effective date of this act, the
2-24 director of the department
of personnel shall:
2-25 1. Calculate the average
salaries paid to police officers as of July 1,
2-26 2000, pursuant to section 1
of this act; and
2-27 2. Forward the figures of
the average salaries calculated pursuant to
2-28 subsection 1 to:
2-29 (a) The chairman of the senate standing committee on finance;
2-30 (b) The chairman of the assembly standing committee on ways and
2-31 means; and
2-32 (c) The fiscal analysis division of the legislative counsel bureau.
